9-1-16: MOVING BUILDINGS:
A.   Moving Permit Required. It is unlawful to move any building within the corporate limits of the Village without first obtaining a permit. This Section shall not apply to the moving of buildings from one point upon any lot to any other point upon the same lot where, in such removal, the building or buildings so moved shall not be moved in, over, or upon any of the streets, alleys, avenues, or other public places property in the Village.
B.   Form of Application; Conditions. Every application for a permit must be submitted on an application form supplied by the Village and must be accompanied by such fees as prescribed in Section 1-12-3 of this Code. The permit application must specify, at a minimum:
1.   The present location of the building to be moved;
2.   The proposed route over which the building is to be moved;
3.   The building’s final location; and
4.   The length of time scheduled to remove the building.
Any permit issued by the Building Commissioner may specify: (i) conditions applicable to the moving of the building necessary to prevent a public nuisance and protect the public safety and welfare; (ii) the route that the permittee must take upon the public ways of the Village in moving the building, and (iii) the time(s) and day(s) that the permit is valid for, as well as the maximum length of time that the building may travel upon public rights-of-way.
C.   Bond Required. A cash deposit or surety bond, in an amount determined by the Building Commissioner, but in no event less than $5,000.00, must be submitted with any application for a moving permit. The return of the cash deposit or surety bond shall be conditioned, among other things, on: (i) the permittee paying for any damages caused by the permittee or its contractors or agents to any trees, pavement, street, sidewalk, poles, wires, utility boxes, or any other property belonging to the Village; (ii) the permittee indemnifying and holding the Village harmless for any liabilities, judgments, costs and expenses which may accrue against the Village as a consequence of the granting of such permit; and (iii) the permittee strictly complies with all of the conditions of the permit.
D.   Failure To Obtain Permit; Penalty. Any person who shall move any building upon any street, avenue, or alley or other public place or public property in the Village, without having first procured a permit or who violates any of the provisions of this Section, shall be deemed guilty of an unlawful act and subject to penalties as provided in Section 9-1-22 of this chapter. Any building being moved by such a person without a license and a permit on any of the streets, avenues, alleys, or other public places in the Village by such licensed person not having the required permit shall be deemed a nuisance.
E.   Exceeding Time Limit; Penalty. The owner of any building, or the contractor for its removal, either or both of them, who shall suffer any such cause a building to be or remain on any of the Village’s streets or alleys, or upon any of the public property of the Village, for any time longer than may be specified in the moving permit, shall be deemed guilty of an unlawful act, and shall be subject to penalties as provided in Section 9-1-22 of this Code, and such building shall be deemed a nuisance subject to abatement by the Village authorities.
