7-1-12: DRIVEWAYS:
A.   Construction Permit Required: No person shall construct or maintain a driveway for vehicles or animals in or across any public sidewalk or parkway in the village without having obtained a permit therefor from the building commissioner.
B.   Approval By Board Of Trustees: No permit for the construction of a driveway for commercial use or the habitual use of any other than the owner or occupant of the premises served shall be issued except on approval by the board of trustees.
C.   Street Grades 1 : All driveways shall be so constructed that the grade shall be the same as that of the adjoining sidewalk at their points of intersection. Such driveways shall meet the gutter of the street at the grade thereof.
D.   Construction Materials: All driveways or parkways where they cross sidewalks shall be constructed of concrete, asphalt or of such other materials as may be approved by the village administrator. All driveways shall be constructed and maintained in such a manner that no undue amount of gravel, cinders or dirt shall wash down into the gutter or onto the pavement of the street. E.   Permit Fees; Bond:
1.   Driveway Construction: Permit fees for the construction of a driveway or the approach thereto shall be as set out in section 1-12-3 of this code, under the category "permit fees". In addition thereto, a surety bond or cash in the amount of one thousand dollars ($1,000.00) shall be deposited with the village treasurer for issuance of a driveway permit requiring breaking of any curbing. Said deposit shall be returned to the person depositing the same upon completion of the work and restoration of the adjoining curb, gutter, roadway, property, parkway and sewer and water facilities to their original condition prior to the construction.
2.   Resurfacing Driveway: Permit fees for the resurfacing of a driveway or the approach thereto shall be as set out in section 1-12-3 of this code, under the category "permit fees".
3.   Damage In Excess Of Deposit: The deposit of said sum shall not relieve the applicant and the person undertaking the work from damages in excess of said deposit.
4.   Sealcoating: Sealcoating of a driveway shall not be considered construction or require a permit therefor. (1988 Code § 5-3A-12; amd. 2009 Code)
