2-3-6: CLASSIFICATION OF LICENSES:
   A.   Class A License:
      1.   Retail Sale In Original Package, Not For Consumption On Premises: A Class A license shall authorize sale at retail of alcoholic liquor in the original package but not for consumption on the premises of sale.
      2.   Hours Of Sale: It shall be unlawful for any person to sell or offer for sale at retail any alcoholic liquor in the original package but not for consumption on the premises of sale in the Village except on a day of the week during the period beginning with the permitted commencement time and ending with the mandatory close time for such day, as follows:

      3.   Fee: The original fee for a Class A license shall be as specified from time to time in section 1-10-7 of this Code. The renewal fee for a Class A license shall be as specified from time to time in section 1-10-7 of this Code.
   B.   Class B License:
      1.   Restaurant: A Class B license shall authorize:
         a.   Restaurant/Sale, Serving, And Consumption Of Alcoholic Liquor On The Premises: A Class B license shall authorize the sale at retail and serving of alcoholic liquor for consumption on the premises of a restaurant, except as otherwise permitted either by Section 6-28.8 or by section 6-33 of the Illinois Liquor Control Act, provided that the primary purpose of and operation of such facility is use as a restaurant and provided that sales occur only during hours when the facility is being operated as a restaurant. For purposes of this section, a "restaurant" shall be defined as any public place, the primary purpose of which is to be kept, used, maintained, advertised and held out to the public as a place where meals are regularly served, without sleeping accommodations, such space being provided with adequate and sanitary kitchen and dining area equipment and capacity and having employed therein a sufficient number and kind of employees to prepare, cook, and serve suitable food for its guests. A "meal" for this purpose means any food and/or beverage that is or may be served for or as part of breakfast, lunch, brunch, or dinner. A coffee shop may be considered a "restaurant" if it regularly serves meals.
         b.   Retail Sale In Original Package, Not For Consumption On Premises: The sale at retail of alcoholic liquor in the original package but not for consumption on the premises of sale.
      2.   Hours Of Sale: It shall be unlawful for any person to sell or offer for sale at retail and/or to serve any alcoholic liquor on the licensed premises of a Class B licensee in the Village except on a day of the week during the period beginning with the permitted commencement time and ending with the mandatory close time for such day, as follows:

   C.   Class C License:
      1.   Golf Club: A Class C license shall authorize:
         a.   Retail Sale, For Consumption On Premises: The sale at retail and serving of alcoholic liquor for a golf club (public/semipublic/private) only for consumption on the premises of sale, except as otherwise permitted either by Section 6-28.8 or by section 6-33 of the Illinois Liquor Control Act, provided such sale and serving is accessory to the main purpose of operating a golf club on the premises and provided further that such sale and serving is accessory to the serving of meals on the premises in conjunction with a restaurant operation and not from vending machines; and also
         b.   Retail Sale In Original Package, Not For Consumption On Premises: The sale at retail of alcoholic liquor in the original package but not for consumption on the premises of sale.
      2.   Hours Of Sale: It shall be unlawful for any person to sell or offer for sale at retail and it shall be unlawful to serve alcoholic liquor in the Village except on a day of the week during the period beginning with the permitted commencement time and ending with the mandatory close time for such day, as follows:

   D.   Class D License:
      1.   Retail Sale And Serving, Consumption On Premises: A Class D license shall authorize the sale at retail and serving of beer and wine for consumption only on the premises of sale, except as otherwise permitted either by Section 6-28.8 or by Section 6-33 of the Illinois Liquor Control Act, provided that the primary purpose of and operation of such facility is use as a restaurant and provided that sales occur only during the hours when the facility is being operated as a restaurant 1 . 
      2.   Hours Of Sale: It shall be unlawful for any person to sell or offer for sale at retail and it shall be unlawful to serve beer and wine for consumption on the premises of sale in the Village except on a day of the week during the period beginning with the permitted commencement time and ending with the mandatory close time for such day, as follows:

      3.   Fee: The original fee for a Class C license shall be as specified from time to time in section 1-10-7 of this Code. There shall be no fee for such a Class D Liquor License or for a related Class F Liquor License if such licenses will be held by a business establishment that already holds a current and valid Class M Liquor License issued by the Village, provided, however, this fee waiver shall expire on May 1, 2021. There shall be no fee for such a Class D Liquor License or for a related Class F Liquor License if such licenses will be held by a business establishment that already holds a current and valid Class M Liquor License issued by the Village, provided, however, this fee waiver shall expire on May 1, 2021.
   E.   Class E License:
      1.   Retail Sale And Serving, Organizations And Lodges: A Class E license shall authorize the temporary sale at retail and serving of alcoholic liquor on the premises for which the license is issued, except as otherwise permitted either by Section 6-28.8 or by section 6-33 of the Illinois Liquor Control Act, by not-for-profit corporations, including but not limited to clubs, associations, and/or lodges, when organized for objects and purposes other than the sale and/or consumption of alcoholic liquor, and other than for commercial purposes, and organized for at least two (2) years prior to the date of the application for a license.
      2.   Hours Of Sale: It shall be unlawful for any person to sell or offer for sale at retail and it shall be unlawful to serve alcoholic liquor for consumption on the premises of sale in the Village except on a day of the week during the period beginning with the permitted commencement time and ending with the mandatory close time for such day, as follows:

      3.   Number Of Licenses: The number of authorized Class E licenses shall be unlimited, provided, however, no licensee shall receive more than four (4) Class E licenses in any twelve (12) month period from May 1 through April 30. Each application for a Class E license shall be considered as an original application and not as an application for a renewal license.
      4.   Fee: The fee for a Class E license shall be as specified from time to time in section 1-10-7 of this Code. There shall be no renewal fee for a Class E license.
      5.   Term: The term of Class E licenses shall be for a period of twenty four (24) hours provided that the license may be extended to a period of time not to exceed ninety six (96) consecutive hours in the aggregate.
   F.   Class F License:
      1.   Retail Sale And Serving, Outdoor Premises: A Class F license shall authorize the sale at retail and serving of alcoholic liquor for consumption only on the premises, except as otherwise permitted either by Section 6-28.8 or by section 6-33 of the Illinois Liquor Control Act, provided such sale and serving is accessory to the main purpose of the serving of meals on such outdoor premises and not a vending machine operation.
      2.   Additional License Required: A Class F license shall only be issued to a holder of a current and valid license of one of the following types: a Class B license, a Class C license, or a Class D license.
      3.   Hours Of Sale: It shall be unlawful for any person to sell or offer for sale at retail any alcoholic liquor for consumption on the outdoor premises of sale in the Village except during the periods beginning with the permitted commencement time and ending with the mandatory close time for the specified day of the week, as follows:

Notwithstanding the foregoing, a Class F license shall not authorize retail liquor sales except at those times respectively authorized by the Class B, Class C, or Class D license to which it relates. (Ord. 2009-O-10, 6-3-2009)
      4.   Fee: The fee for a Class F license shall be as specified from time to time in section 1-10-7 of this Code.
      5.   Term: The effective period for any Class F license shall be for the license year; provided, however, that during the entire term that a Class F license is in effect, the holder of a Class F license must, at all times during such term, be the holder of a current and valid Class B, Class C, Class D, or Class M license. Accordingly, if, for any reason whatsoever, such Class B, Class C, Class D, or Class M license is revoked, suspended or terminated during the term of the Class F license, the Class F license, upon the revocation, suspension or termination of the Class B, Class C, Class D, or Class M license, shall also be automatically and immediately revoked, suspended or terminated, as the case may be, without any further action by the Village.
      6.   Definition: As used in this subsection F, "outdoor premises" shall mean:
         a.   An area immediately adjacent to the main building for which the Class B, Class C, Class D, or Class M license has been issued where alcoholic liquor may be served pursuant to a Class F license issued by the Village; and
         b.   Any point within such area shall not be more than one hundred fifty feet (150') from said main building.
         c.   No part of the outdoor premises shall include any parking lot or parking area.
      7.   Additional Restrictions: The following shall be applicable with respect to the outdoor premises:
         a.   The outdoor premises shall be owned or leased, and operated by the same person to whom the respective Class B, Class C, Class D, or Class M license has been issued.
         b.   At all times, the outdoor premises shall be used in conjunction with the operation of the restaurant operation carried on in the main building.
         c.   The outdoor premises shall not block, in any way whatsoever, any entrance to or exit from the said main building.
         d.   The outdoor premises shall be fully enclosed by a fence so as to discourage ingress to and egress from the area except through designated entrances and exits.
         e.   The maximum number of persons allowed at any time in such outdoor premises shall be seventy five (75).
         f.   Live entertainment shall not be permitted on the outdoor premises except when specifically approved in advance by the President and Board of Trustees. Any other type of entertainment provided, such as, but not limited to, music from a jukebox, radio, phonograph, shall not exceed sixty (60) decibels in noise level as measured from the property line between the property on which the outdoor premises is located and any adjoining property.
         g.   The artificial lighting of the outdoor premises shall be sufficient to provide for the safety of all persons using such area but shall not be such so as to create a nuisance or to inhibit the normal use and enjoyment of surrounding property. Notwithstanding the foregoing, as measured from any point, the artificial lighting shall not exceed one-tenth (0.1) foot-candle either within or without the outdoor premises.
         h.   The entire operation and use of the outdoor premises shall be carried on so as not to create a health or safety hazard or to create a nuisance or to interfere with the use and enjoyment of surrounding property.
   F-2.   Class F.2 Outdoor License:
      1.   Retail Sale And Serving, Outdoor Premises: A Class F.2 license shall authorize the sale at retail and serving of alcoholic liquor for consumption only on the premises, except as otherwise permitted either by Section 6-28.8 or by Section 6-33 of the Illinois Liquor Control Act, provided such sale and serving is accessory to the main purpose of the serving of meals on such outdoor premises and not a vending machine operation.
      2.   Additional License Required: A Class F.2 license shall only be issued to a holder of a current and valid Class B license.
      3.   Hours Of Sale: It shall be unlawful for any person to sell or offer for sale at retail any alcoholic liquor for consumption on the outdoor premises of sale in the Village except during the periods beginning with the permitted commencement time and ending with the mandatory close time for the specified day of the week, as follows:

      4.   Fee: The fee for a Class F.2 license shall be as specified from time to time in Section 1-10-7 of this Code.
      5.   Term: The effective period for any Class F.2 license shall be for the license year; provided, however, that during the entire term that a Class F.2 license is in effect, the holder of a Class F.2 license must, at all times during such term, be the holder of a current and valid Class B license. Accordingly, if, for any reason whatsoever, such Class B license is revoked, suspended or terminated during the term of the Class F.2 license, the Class F.2 license, upon the revocation, suspension or termination of the Class B license shall also be automatically and immediately revoked, suspended or terminated, as the case may be, without any further action by the Village.
      6.   Definition: As used in this Subsection F.2, "outdoor premises" shall mean:
         a.   An area used for Class F.2 operations immediately adjacent to the main building for which the Class B license has been issued where alcoholic liquor may be served pursuant to a Class F.2 license issued by the Village; and
         b.   Any point within such area shall not be more than one hundred feet (100') from the main building on the Class B licensed premises.
         c.   No part of the outdoor premises shall include any parking lot or parking area, nor shall such outdoor premises include any walkways going into or coming out of the main building.
      7.   Additional Restrictions: The following shall be applicable with respect to the outdoor premises:
         a.   The outdoor premises shall be owned or leased, and operated by the same person to whom the respective Class B license has been issued.
         b.   At all times, the outdoor premises shall be used in conjunction with the operation of the restaurant operation carried on in the main building.
         c.   The outdoor premises shall not block, in any way whatsoever, any entrance to or exit from the said main building.
         d.   The outdoor premises shall be generally enclosed by barrier(s) such as fencing, dense landscaping, and/or by the main building of the licensed premises so as to discourage ingress to and egress from the area except through designated entrances and exits.
         e.   The maximum number of persons allowed at any time in such outdoor premises shall be one hundred fifty (150).
         f.   Live entertainment shall be permitted on the outdoor premises, amplified to no more than sixty (60) decibels in noise level as measured from the property line between the property on which the outdoor premises is located and any adjoining property, except when specifically approved in advance by the Village President and Board of Trustees. Any other type of entertainment provided, such as, but not limited to, music from a jukebox, radio, phonograph, shall also not exceed sixty (60) decibels in noise level as measured from the property line between the property on which the outdoor premises is located and any adjoining property.
         g.   The lighting of the outdoor premises shall be sufficient to provide for the safety of all persons using such area but shall not be such so as to create a nuisance or to inhibit the normal use and enjoyment of surrounding property. Notwithstanding the foregoing, as measured from any point, the artificial lighting shall not exceed one-tenth (0.1) foot-candle on any property line of the licensed premises.
         h.   The entire operation and use of the outdoor premises shall be carried on so as not to create a health or safety hazard or to create a nuisance or to interfere with the use and enjoyment of surrounding property.
   G.   Class G License:
      1.   Retail Sale And Serving, Consumption On Premises: Subject to the conditions hereinafter stated, a Class G license shall authorize the sale at retail and serving of alcoholic liquors for consumption on the premises of sale only, except as otherwise permitted either by Section 6-28.8 or by section 6-33 of the Illinois Liquor Control Act, but only subject to and in compliance with the following conditions: provided that the principal purpose of and operation of such facility is use as a snack bar and/or restaurant within and accessory to a recreational and/or sports and fitness facility, provided that sales occur only during hours when food is being served, excluding any food from vending machines.
      2.   Hours Of Sale: It shall be unlawful for any person to sell or offer for sale at retail and it shall be unlawful to serve alcoholic liquor for consumption on the premises of sale in the Village except during the periods beginning with the permitted commencement time and ending with the mandatory close time for such day, as follows:

      3.   Fee: The original fee for a Class H license shall be as specified from time to time in section 1-10-7 of this Code. The renewal fee for a Class H license shall be as specified from time to time in section 1-10-7 of this Code.
   I.   Class I License:
      1.   Brewpub: A Class I license shall authorize the sale at retail on the premises for immediate delivery or by phone order, electronic mail, or regular mail order for future delivery, of only beer and wine in the original package container, but not for consumption on the premises.
      2.   Additional License Required: A Class I license shall only be issued to a holder of a then valid Class B license.
      3.   Hours Of Sale: There shall be no mandatory closing time for the holder of a Class I license, except that for sales on the premises for immediate delivery shall be limited to those hours of sales applicable to a Class B license.
      4.   Number Of Licenses: There is only one Class I license authorized.
      5.   Fee: The original fee for a Class I license shall be as specified from time to time in section 1-10-7 of this Code. The renewal fee for a Class I license shall be as specified from time to time in section 1-10-7 of this Code.
   J.   Class K License:
      1.   A Class K license is a special temporary license, for a period of not to exceed four (4) days except as otherwise approved by the Village President and issued by the Village President acting as Local Liquor Control Commissioner only to a not-for-profit corporation (a "not-for-profit") or to a governmental entity, which has been in existence for at least two (2) years and whose purpose and function is providing benefit, assistance or support to charitable, athletic, religious, youth service, or any civic or community service programs located within and/or serving the Village, for an event where alcoholic liquor is to be sold and served by such a qualifying organization for an event to be located in the Village (the organizations described above are for convenience sometimes hereinafter collectively referred to as "qualifying organizations") which event will be held for community celebration, commemoration, memorial, hospitality, fundraising, and/or for similar purposes or where alcoholic liquor may or may not be sold at such an event but will be served by a qualifying organization on Village property. A qualifying organization may also be required to obtain a special event license for such event whether such alcoholic liquor is sold by the officers, members, volunteers, employees, and/or agents of the qualifying organization or where alcoholic liquor may or may not be sold at such an event but will be served by such a qualifying organization on Village property.
      2.   Each application by a qualifying organization shall contain a copy of the applicant's recorded Articles of Incorporation and a copy of the applicant's most recent annual report filed with the Secretary of State of the State of Illinois. Notwithstanding the foregoing, each application submitted by a qualifying organization shall include reasonable evidence of the purpose and function that such qualifying organization is providing. All applications shall state the time period for which the license shall be applicable and shall state whether the license is for an outdoor or an indoor location or some combination thereof.
      3.   Such a Class K special temporary license shall authorize: a) the sale and serving of alcoholic liquor at an event held for community celebration, commemoration, memorial, hospitality, fundraising, and/or for similar purposes, by officers, members, volunteers, employees, and/or agents of the specified qualifying organization where a special event license from the State of Illinois Liquor Control Commission is also required; or b) the serving of alcoholic liquor at such an event held for community celebration, commemoration, memorial, hospitality, fundraising and/or for similar purposes by officers, members, volunteers, employees, and/or agents of a qualifying organization at a location on Village property where the sale of alcoholic liquor may or may not occur. The fee for such Class K special temporary license shall be as specified from time to time in section 1-10-7 of this Code per day, but no separate application fee shall be charged. A qualifying organization shall be required to obtain such a Class K license for each and every such event it holds within the Village, and the number of events held by any such qualifying organization shall not exceed six (6) such events in any calendar year. No such special license shall be issued to any applicant other than to the Village until the Village President has received evidence that the applicant shall have satisfactory dramshop liability insurance coverage in effect during the period for which each such special license shall be issued.
   K.   Class L License: A Class L license allows within the area specifically designated in the license as the premises, the immediate consumption of table wine that was not purchased on the premises, subject to the following conditions:
      1.   A Class L license shall only be issued to a holder of a valid, current Lake Barrington, Illinois, Class B (restaurant), Class C (golf club), Class D (restaurant/wine and beer) and/or Class F (outdoor restaurant) license and only if such license(s) are still valid and in effect. Accordingly, if for any reason whatsoever, during the term of the Class L license, any one of such Class L licensee's license(s) required pursuant to this subsection is revoked, suspended or terminated, then upon such revocation, suspension or termination, as the case may be, the licensee's Class L license shall also be immediately revoked, suspended or terminated, as the case may be, without any further action of the Village; and
      2.   A Class L license shall only permit service and consumption within the licensed premises during the times that alcoholic liquor may be served and consumed pursuant to the regulations for the underlying license (i.e., the Class B, C, D, and/or F license); and
      3.   A Class L license is only intended to and shall only permit the consumption on the premises of table wine that is not purchased on the premises, except as otherwise permitted either by Section 6-28.8 or by section 6-33 of the Illinois Liquor Control Act. The use of the term "alcoholic liquor" or any other term or phrase of similar import with respect to a Class L license is not intended to permit and shall not be construed to permit the consumption on the premises of any kind of alcoholic liquor (other than table wine) that is not purchased on the premises. The term "table wine" as used in reference to a Class L license means any alcoholic beverage obtained by the fermentation of the natural contents of fruits, or vegetables, containing sugar, including such beverages when fortified by the addition of alcohol or spirits, as defined in the Illinois Liquor Control Act; and
      4.   A Class L license holder may charge a reasonable fee for each bottle of table wine that is provided by the customer and is served by the license holder; and
      5.   A Class L license holder shall not advertise or otherwise promote any of the activities permitted under the provisions of the Class L license; and
      6.   Whether indoors, outdoors, or a combination thereof, the premises upon which alcoholic liquor may be sold and served pursuant to a Class L license shall be the same area as the premises as that term is defined in the underlying Class B, C, D, and/or F license(s); and
      7.   All of the regulations, including, but not limited to, the restricted hours of sale, set forth in this section applicable to a Class B, C, D, and/or F license shall also apply to table wine, if any, served pursuant to a Class L license; and
      8.   The original fee for a Class L license shall be as specified from time to time in section 1-10-7 of this Code. The renewal fee for a Class L license shall be as specified from time to time in section 1-10-7 of this Code.
   L.   Class M License:
      1.   A Class M license allows the sale of alcoholic liquors for consumption off the premises as an incidental part of food service; provided that such sales are provided by a caterer and are limited to invited guests at catered functions. A Class M license shall only be issued to a caterer who conducts business from a location established within the boundaries of the Village. For purposes of a Class M license, a "caterer" or terms of similar import shall mean and refer to a business or activity, the purpose of which is the processing, preparing and serving of meals or food items for consumption off the premises where prepared and on the premises of a specific customer. At all times, the Class M license holder shall comply with all of the provisions of this chapter governing licenses and license holders. There shall be no limit to the number of Class M licenses issued.
      2.   Notwithstanding anything to the contrary set forth in this Code, the annual liquor license fee for a caterer liquor license shall be as specified from time to time in section 1-10-7 of this Code.
   M.   Class N License:
      1.   Retail Sale, Beer And Wine: A Class N license shall authorize the sale at retail in a gas station convenience store of only beer and/or wine in the original package container but not for consumption on the premises of sale.
      2.   Hours Of Sale: It shall be unlawful for any person to sell or offer for sale at retail any beer and wine in the original package not for consumption on the premises of sale in the Village except on a day of the week during the period beginning with the permitted commencement time and ending with the mandatory close time for such day, as follows:

      3.   Employee Twenty One Years Of Age To Be Present: During the hours of sale specified in subsection M2 of this section, at least one store employee of twenty one (21) years of age or older must be present on the licensed premises.
      4.   Fee: The original fee for a Class N license shall be as specified from time to time in section 1-10-7 of this Code. The renewal fee for a Class N license shall be as specified from time to time in section 1-10-7 of this Code.
   N.   Class O License:
      1.   Retail Goods Establishments: In connection with a retail goods establishment, a Class O license shall authorize the sale at retail and serving of alcoholic liquor on the licensed premises for consumption only on the licensed premises. A Class O license shall also be subject to the following additional conditions:
         a.   Incidental to Business Operation: The sale and/or serving of alcoholic liquor on the licensed premises shall be merely incidental to the primary business operation of the licensed premises as a retail goods establishment, and the licensed premises shall not be advertised or otherwise held out to be a drinking establishment;
         b.   Employee Twenty-One Years of Age to be Present: During the hours of sale specified in Subsection 2 of this Section, at least one (1) employee of the respective licensed retail goods establishment twenty-one (21) years of age or older must be present on the licensed premises;
         c.   Live Entertainment Prohibited: No live entertainment of any nature shall be permitted on the licensed premises;
         d.   No Signs: No sign or any other external indicia shall be permitted on the licensed premises or on the surrounding property that indicates that alcoholic liquor is available for sale and/or serving at the licensed premises;
         e.   No holder of a Class O liquor license shall sell alcoholic liquor other than such as authorized by their Class O liquor license; and
         f.   In no case shall the sale, service, and/or consumption on the licensed premises of alcoholic liquor take place outside of the normal business hours of the licensed premises and, in any event, not outside of the hours for liquor service as otherwise set forth in Subsection 2, "Hours of Sale", below.
      2.   Hours Of Sale: It shall be unlawful for any person to sell or offer for sale at retail any alcoholic liquor for consumption on the licensed premises of sale in the Village, except during the periods beginning with the permitted commencement time and ending with the mandatory close time for the specified day of the week, as follows:

      3.   Fee: The fee for a Class O license shall be as specified from time to time in Section 1-10-7 of this Code.
   O.    Hours Of Sale:
      1.   Holidays And Other Events: Notwithstanding anything contained in this section to the contrary, for any Village liquor license which authorizes the sale at retail and/or the serving of alcoholic liquor on New Year's Day, St. Patrick's Day, Memorial Day, the Fourth of July, Labor Day, Halloween, the day before Thanksgiving Day, Thanksgiving Day, Christmas Eve, Christmas Day, and Super Bowl Sunday, the mandatory closing hours shall be the same as provided for by this section for Friday and Saturday mandatory closing times for their respective license(s).
      2.   Temporary Modifications Of Hours Of Sale And/Or Service: Notwithstanding anything provided in this Code to the contrary, the Village President, acting as the Village of Lake Barrington Local Liquor Control Commissioner, may in his or her sole discretion, temporarily extend any mandatory closing time and/or temporarily allow an earlier commencement time for the sale and/or serving of alcoholic liquor on behalf of any holder of a current, valid Village liquor license, for a specific day or days and/or for a specific time period of any length in order to reasonably accommodate the economic interests of the affected licensee(s) while giving due consideration to the public health and safety when the Village President determines that such a temporary extension of the closing time(s) and/or a temporary earlier commencement time for the sale and/or serving of alcoholic liquor is appropriate to specific circumstances. Such extension by the Local Liquor Control Commissioner shall be accomplished by a written order executed by the Local Liquor Control Commissioner, and such written order may be communicated by such means as may be reasonably expected to reach the affected licensee(s).
