If any person shall fail or refuse to obey any order of the Maintenance Supervisor given pursuant to the provisions of §§ 51.056 and 51.057 inclusive as hereinabove set forth, or if any owner or person in charge of a place of business within the town shall maintain a commercial washrack or other washing facility therein or a commercial business establishment referenced in § 51.056 without having the same connected with a sand or grease trap that complies with the provisions of §§ 51.056 and 51.057, or if any person shall in any other manner violate any other provisions of §§ 51.056 and 51.057, such person, upon conviction thereof, shall be fined, notwithstanding the provisions as set forth in § 51.999, not less than $50 for the first day of noncompliance; not less than $100 for the second day of noncompliance, and not less than $150 for the third day of noncompliance, increased by increments of $50 per day after the fourth day, up to a maximum of $300 per day. Each day of noncompliance shall be deemed to be a separate and distinct offense. If any person or business entity shall fail to maintain good and sufficient sand or grease traps or controls and as a result thereof, damage is caused to the sewer system, then such damages shall be paid by the owners of the said property, occupant or business entity causing the same. In the event of failure or refusal of said owner, occupant or business entity to pay such damages as assessed, the town may bring such action as it deems necessary and proper in a court of competent jurisdiction to compel the payment thereof, and in connection with such proceedings, the town shall be awarded its reasonable attorney fees incurred in connection therewith.
