§ 35A.02 DEFINITIONS.
   For the purpose of this chapter, the following definitions shall apply unless the context clearly indicates or requires a different meaning.
   ABATEMENT COSTS. The necessary and reasonable expenses for and associated with the city having to provide corrective actions that the violator failed to perform, including, but not limited to, clearing of debris, rubbish or junk, preventing unauthorized entry to, or demolishing all or a portion of a structure or premises, mowing or trimming of grass or vegetation, or taking any other action with regard to a structure or premises necessary to remedy a violation and to maintain and preserve the public health, safety and welfare in accordance with city ordinances and zoning regulations.
   ADMINISTRATIVE COSTS. The specified fee charged by the city for conducting an administrative hearing before the Code Enforcement Board or other administrative expenses incurred in cases requiring extraordinary services.
   CITY. The City of La Grange, Kentucky, also referred to as the local government body under KRS 65.8801 through 65.8840.
   CODE ENFORCEMENT BOARD. The administrative body created and acting under the authority of this chapter, which was promulgated pursuant to KRS 65.8801 to 65.8840, to enforce the provisions of the city’s code of ordinances, as amended from time to time.
   CODE ENFORCEMENT OFFICER. The nonelected city official appointed by the Mayor with the approval of the City Council pursuant to § 31.35 of this code of ordinances to carry out the duty of enforcing city ordinances and other duties enumerated under § 31.43, who shall perform all duties assigned by the Chief of Police, also referred to as the Ordinance Enforcement Officer in § 31.43, the Enforcement Official in § 155.30, and the Citation Officer in KRS 83A.08. The CODE ENFORCEMENT OFFICER may delegate to any city or county police officer, sheriff, deputy sheriff, safety officer or other public law enforcement officer the authority to issue or serve citations.
   COUNTY. Oldham County, Kentucky.
   FINAL ORDER. Any order:
      (1)   Issued by the Code Enforcement Board;
      (2)   Issued by an assigned hearing officer that is not appealed to the Code Enforcement Board;
      (3)   Created because a violator neither paid nor contested the citation within 14 days; and
      (4)   Created because of a failure of a violator to appear at a hearing the violator requested to contest the citation.
   IMMINENT DANGER. A condition which is likely to cause serious or life-threatening injury or death at any time.
   NUISANCE.
      (1)   A condition or use of premises that:
         (a)   Is detrimental to the property of others or tends to cause substantial diminution in the value of other properties in the community;
         (b)   Renders the property dangerous, or is detrimental or adverse to health or welfare of residents in the community; or
         (c)   Is generally offensive to the public having no redeeming social value.
      (2)   A nuisance shall have the meanings ascribed to the term in the International Property Maintenance Code adopted by Ord. 12-2019 passed 11-4-2019, as codified in §§ 155.15 and 155.16.
   OFFENDER. A person who commits a violation of an ordinance classified as a civil offense, sometimes referred to as a violator as that term is used in this chapter.
   ORDINANCE. An official action of the LaGrange City Council approved by the Mayor which constitutes a regulation of a general and permanent nature and enforceable as a law. The Code Enforcement Board is only authorized to enforce ordinances the violation of which is a civil offense.
   ORDINARY PUBLIC VIEW. A sight line within normal visual range by a person on a public street or sidewalk adjacent to real property.
   OWNER. A person, association, corporation, partnership or other legal entity having title of or a legal interest in or management rights for real property located within the City of LaGrange on which a violation has occurred.
   PREMISES. A lot, plot, parcel of land or real property, including any structures or improvements thereon, where an alleged violation or civil offense has occurred.
   UNSAFE BUILDINGS. Refers to the general provisions and minimum standards according to definitions contained in Chapter 155 of this code of ordinances, and including the definitions contained in the International Property Maintenance Code adopted by the City of La Grange in Ord. 12-2019 passed 11-4-2019, as codified in §§ 155.15 and 155.16.
   VIOLATOR.
      (1)   The person who is alleged to have violated an ordinance or committed an offense on or in connection with the subject premises, including:
         (a)   Tenants, occupants or invitees upon the premises;
         (b)   The legal guardian of a violator who is under 18 years of age or under a legal disability; or
         (c)   The owner of the premises where the violation was permitted to occur or continue after notice of same.
      (2)   A VIOLATOR is sometimes referred to as an offender as that term is used in this chapter.
