§ 91.14 REGULATIONS REGARDING OPEN BURNING.
   The following regulations shall apply to the open burning of landscape waste:
   (A)   Controls. Open burning of landscape waste must be controlled to prevent smoke or offensive odors at all times.
   (B)   Burning limitations. No open burning of landscape waste shall be permitted after sunset. No open burning of landscape waste shall be permitted on national holidays or Halloween.
   (C)   Burning on city property prohibited. Open burning of landscape waste is prohibited on city streets, alleys or sidewalks.
   (D)   Constant attendance. All burning of landscape waste shall be constantly attended by a person 15 years of age or older, who shall completely extinguish the fire before abandoning or leaving the fire.
   (E)   Burning location. The burning location shall be kept clear of obstacles and structures or anything that may become flammable or damaged as a result of the combustion of landscape waste.
   (F)   Prohibit or suspend burning. The Fire Chief, with agreement of the Police Chief, can suspend or prohibit any burning otherwise permitted under this chapter if it is determined that conditions are such that burning substantially threatens the safety of persons or property. Notice must be given at least 24 hours prior to any citation for violation being issued.
   (G)   Conflict with state regulations. If a provision of this chapter is in conflict with the Illinois Environmental Protection Agency regulations, then such regulations shall control.
   (H)   Controlled burn. Nothing in this section shall prohibit the Fire Department from burning materials in a controlled manner, under the supervision of the Fire Department and with the approval of the Fire Chief and the Mayor.
