No person shall dump, deposit, drop, throw, discard or otherwise dispose of litter from any motor vehicle upon any public highway, upon any public or private property or upon or into any pond, stream or body of water in this City except as permitted by law, nor shall any person transport by any means garbage or refuse from any dwelling, residence, place of business, farm or other site to and deposit such material in, around or on top of trash barrels or other receptacles placed along streets or in public parks. It shall be unlawful for any person to operate any vehicle upon any public street, lane, alley, or park in the City unless the cargo is in containers or covered by a tarpaulin or tied down in such a manner as to prevent any part of its contents from falling or being scattered upon any such public street, lane, alley, or park in said City. A. Premises Kept Clean: The owner or person in control of any property which is held out to the public as a place of assemblage, for the transaction of business, for recreation or as a public way and including but not limited to restaurants, shopping centers, fast food outlets, convenience stores, stores, hotels, motels, industrial establishments, office buildings, apartment buildings, housing projects, construction sites, loading and unloading docks, gas stations, and hospitals and clinics shall at all times keep the premises clean of all litter thrown or left on said premises and shall take measures including daily cleanup of the premises to prevent litter or litter drifting or blowing to adjoining premises.
B. Receptacles Required: Receptacles of sufficient size, number and location shall be placed on all premises, public and private, for the disposition and containment of litter.
C. Receptacles Conspicuously Identified: The owner or person in control of any property which is held out to the public as a place for assemblage, the transaction of business, recreation or as a public way shall conspicuously identify receptacles for the disposal of litter. (Ord. 80-2, 2-4-1980)
All owners or occupants of property shall maintain their property in a clean and litter-free manner, including sidewalks, grass strips, one-half (1/2) of alleys, curbs or rights of way up to the edge of the pavement of any public street. In addition, no owners or occupants of such abutting property shall discharge any litter, including grass clippings and lawn debris, into the street right of way. (Ord. 03-05, 5-21-2001)
All household and commercially generated garbage, rubbish, where practical, and materials that are subject to movement by the wind or air shall be containerized or deposited in a securely tied plastic bag before the same are allowed to leave the premises where they were collected.
