(A) Generally.
(1) The owner or operator of any such vehicle who has been notified of such violation in the manner provided in this chapter may, within the time specified in the notice, present himself by mail or in person with the notice or ticket at the Bureau and answer the violations noted on such notice or ticket by voluntarily paying the $25 civil penalty.
(2) Any vehicle owner/operator receiving a ticket under the provisions of §§ 72.40 et seq. shall be allowed to pay the penalty amount, without contesting the violation, by appearing in person at the Kill Devil Hills Tax and Finance Department, 102 Town Hall Drive, between the hours of 8:00 a.m. and 5:00 p.m., Monday through Friday, and paying the amount so marked on the ticket. Civil penalty payments may also be mailed to the Tax and Finance Department, P.O. Drawer 1719, Kill Devil Hills, North Carolina 27948 within 15 days of issuance of the notice or ticket.
(B) Construction. The penalty provided in this section to be paid to and received by the Traffic Violations Bureau shall in no event be construed to be enforced imposition of fines or forfeitures, but such amounts shall be construed to be civil penalties which offenders may voluntarily pay for those minor traffic law violations which are expressly made to fall within the application of this chapter to the extent therein provided. Such penalty shall be paid within 15 days of the issuance of the notice or ticket or such sum shall be recovered by the town in a civil action in the nature of debt.
(C) Disposition of proceeds. All penalties paid to the town for traffic violations as set forth in §§ 72.40 et seq. shall be paid into the General Fund of the town.
