§ 72.17 DESIGNATED PARKING SPACES FOR COMMERCIAL BUSINESS EMPLOYEE PARKING SPACES.
The Town Board of Trustees is authorized to designate parking spaces for any commercial business employees along Swanzey Street.
   (A)   Lines shall be painted upon the curb adjacent to each commercial business employee parking space and upon the street, designating the parking space for each vehicle to park within the lines. It is unlawful to park any vehicle across any such line, or to park a vehicle in such a position that it shall not be entirely within the space designated by the lines.
   (B)   No person other than a commercial business employee may park in the designated space between the hours of 6:00 a.m. and 12:00 a.m. Any person who parks a vehicle found in violation of this section shall, within 72 hours from the time when the notice of violation was attached to the vehicle, pay the Finance Office, as a penalty for and in full satisfaction of the violation in accordance with § 72.05.
   (C)   (1)   No person shall park or otherwise cause a vehicle to occupy a designated employee space without prominently displaying a valid parking permit issued by the city, upon application for that purpose. Parking permits shall be valid through the date shown on the face of the permit or until the holder of the permit no longer meets the eligibility requirements determined by the city.
      (2)   No person shall display or allow to be displayed a permit unless said permit is issued to that person. No person shall disfigure, display, obscure, loan, give or otherwise allow any other person to use a permit issued to them. Any vehicle parked in an employee designated space without a permit so displayed will be deemed to be in violation of this chapter.
      (3)   Emergency, government and public utility vehicles engaged in official business shall be exempt from permit requirements. The issuance of an employee permit is applicable only to those spaces so designated and the issuance of said permit does not guarantee the availability of a parking space.
      (4)   For the purpose of this section, the following definition shall apply unless the context indicates or requires a different meaning.
         PROMINENTLY DISPLAYED.
            1.   For cars, trucks and other enclosed vehicles: to be suspended from the rear view mirror or visor so as to face toward the front of the vehicle and visible from the exterior of the vehicle.
            2.   For motorcycles: To be attached to the handlebar in such a manner as to be visible from the front of the vehicle.
   (D)   Any person who operates a vehicle found in violation of this section shall, within 72 hours from the time when the notice of violation was attached to the vehicle, pay the Finance Office, as a penalty for and in full satisfaction of the violation in accordance with § 72.05.
