§ 32.055 DEPARTMENT OF PUBLIC WORKS.
   (A)   There is hereby established a department of the city government to be known as the Department of Public Works. The head of this department shall be known as the Director of Public Works, who shall be appointed by the City Manager. The Department of Public Works shall include:
      (1)   The Water Division, which includes the storage, distribution, and production of potable water; the maintenance of these facilities; all equipment and materials necessary to carry out these functions; a Superintendent, who may, with the authorization of the Manager be the Director of Public Works; and all personnel, under the supervision of the Water Superintendent, necessary to carry out the functions of this division. If the Water Superintendent is not qualified, per the state requirements, to be the Chief Operator, a Chief Operator will be appointed by the City Manager upon the recommendation of the Director of Public Works.
      (2)   The Sewer Division, which includes the sanitary sewer system; the storm sewer system, including storm water ditches and creeks; the waste water treatment plant; all equipment and materials necessary to carry out these functions; and all personnel necessary to carry out the functions of this division.
      (3)   The Street Division, which includes the streets and alleys of the city; the repair and cleaning of the streets, paving, viaducts; all equipment and materials necessary to carry out these functions; and all personnel necessary to carry out the functions of this division.
      (4)   The Sanitation Division, which includes the City's landfill, pick-up of trash and rubbish, recycling; all equipment and materials necessary to carry out these functions; and all personnel necessary to carry out the functions of this division.
   (B)   Should the City Council authorize a contractor to carry out any of the above functions or parts of them, the Director of Public Works shall be responsible for monitoring the contracts, and reporting to the City Manager any actions that maybe in non-compliance with the contracts.

§ 32.056 ASSIGNMENT OF PERSONNEL.
   Personnel assigned to the various divisions of this department shall be used by the Director of Public Works in a manner that is most effective and efficient for the department as a whole.

§ 32.057 COMPENSATION OF PUBLIC WORKS EMPLOYEES.
   (A)   To the extent and as required by “An Act regulating wages of laborers, mechanics and other workers employed in any public works by the state, county, city or any public body or any political subdivision or by any one under contract for public works,” approved June 26, 1941 (ILCS Ch. 820, Act 130, §§ 1 et seq), as amended, the general prevailing rate of wages in this locality for laborers, mechanics and other workers engaged in construction of public works coming under the jurisdiction of the city is hereby ascertained to be the same as the prevailing rate of wages for construction work in the Henry County area as determined by the Department of Labor of the State of Illinois as of June 5, 2017, a copy of that determination being attached to Ord. 3932 and incorporated herein by reference. Copies of said determination are obtainable from the City Clerk. As required by the Act, any and all revisions of the prevailing rate of wages by the Department of Labor of the State of Illinois shall supersede the Department’s June determination and apply to any and all public works construction undertaken by the city. The definition of any terms appearing in this section which are also used in the Act shall be the same as in the Act.
   (B)   Nothing herein contained shall be construed to apply the general prevailing rate of wages as herein ascertained to any work or employment except public works construction of the city to the extent required by the Act.
   (C)   The City Clerk shall publicly post or keep available for inspection by an interested party in the main office of the city, this determination or any revisions of such prevailing rate of wages. A copy of this determination or of the current revised determination of prevailing rate of wages then in effect shall be attached to all contract specifications.
   (D)   The City Clerk shall mail a coy of this determination to any employer, and to any association of employers and to any person or association of employees who have filed their names and addresses, requesting copies of any determination stating the particular rates and the particular class of workers whose wages will be affected by such rates.
   (E)   The City Clerk shall promptly file a certified copy of Ord. 3932 with both the Secretary of State Index Division and the Department of Labor of the State of Illinois.
   (F)   The City Clerk shall cause to be published in a newspaper of general circulation within the area an abbreviated copy of Ord. 3932 to announce that the same has been passed and is on file, and such publication shall constitute notice that the determination is effective and that this is a determination of this public body, with the complete ordinance to be published and made available for public inspection in pamphlet form.

AMBULANCE SERVICE DEPARTMENT
§ 32.070 ESTABLISHMENT.
   There is hereby created an executive department of the municipal government of the city to be known as the Ambulance Service Department which shall consist of a Director of Ambulance Service, Assistant Director of Ambulance Service and such members thereof as may from time to time be fixed by resolution of the City Council.
