§ 113.01  DEFINITIONS.
   For the purpose of this chapter, the following definitions shall apply unless the context clearly indicates or requires a different meaning.
   APPLICANT or INTERESTED PARTY.  Any person, partnership, or corporation which is an applicant for a taxi franchise or who is an employee of an applicant for a taxi franchise; any person who is a partner in a partnership which is an applicant for a taxi franchise; and any person, partnership, or corporation which is an officer, director, or principal stockholder of a corporation which is an applicant for a taxi franchise.
   PRIVILEGE REGULATING LICENSE.  License provided to the applicant by the Town of Kenly after the applicant has satisfied all requirements to operate a taxi franchise.
   TAXICAB.  A vehicle that has been inspected and approved by an authorized N.C. Inspection Station and inspected and approved by the Town of Kenly Police Department to operate within the Town of Kenly.

§ 113.02  PROCEDURES FOR ACQUIRING A PRIVILEGE REGULATING LICENSE.
   (A)   The applicant shall fill out an application for a taxi franchise.  An application will be considered only if all questions are answered.  The application shall be acquired from the Town Clerk and brought back to the Town Clerk when completed.
   (B)   The Town Clerk shall forward the application to the Police Chief upon receipt of the application by the applicant/interested party.  The Police Department shall verify all information provided on the application by the applicant.
   (C)   Upon verification of information, the Police Chief shall establish a time with the applicant to inspect and approve all proposed vehicles to be used as taxi cabs.
   (D)   The Police Chief shall check and inspect all safety equipment to ensure that the safety of the passengers will be provided.  The vehicle(s) shall also meet all requirements as established by the North Carolina Department of Transportation - Division of Motor Vehicles.
   (E)   Upon approval of the vehicle(s), the Police Chief shall execute the application and return it to the Town Clerk.  If the vehicle(s) do not meet with the approval of the Police Chief, the applicant shall be notified of the deficiencies.  The applicant shall have the deficiencies corrected and notify the Police Chief that the deficiencies have been corrected and they shall establish a time for the re-inspection.
   (F)   The Town Clerk shall have the approved application presented at the upcoming Town Council meeting for the Town Council approval.
   (G)   Upon approval by the Town Council, the Town Clerk shall issue a privilege regulating license and notify the applicant of the approval of the application.
   (H)   The applicant shall pay $15 per year per approved taxicab.
   (I)   The applicant shall renew the privilege regulatory license on an annual basis in accordance with the town schedule for other privilege license.
