§ 152.02 PROCEDURE.
   (A)   General. The procedure for obtaining the approval of the Plan Commission and Board of Trustees of a plat of subdivision shall be as follows. A tentative plat shall be submitted to the Village Board, and shall be referred to the Plan Commission for detailed examination, change or amendment and for approval or disapproval. If approved, a final plat embodying the details of the approved tentative plat shall then be prepared and submitted to the Plan Commission. Upon approval of this final plat, the Commission shall recommend it to the Village Board for final approval. Upon obtaining final approval by the Village Board, the Village Clerk shall endorse on the original and on the duplicate the fact that the same has been approved and shall attach his or her signature and the corporate seal of the village thereto, whereupon the plat of subdivision shall be entitled to record or registration as provided by law.
   (B)   Notice.
      (1)   Notice of the initial meeting of the Plan Commission at which any application for relief under this chapter is to be considered shall be provided as required by this section. The applicant shall notify, in writing, by first class mail or hand delivery, all property owners within 400 feet of the boundaries of the property that is the subject of the application, excluding measurement of streets and rights-of-way, not less than 15 days or more than 30 days in advance of the scheduled Plan Commission meeting date.
      (2)   The mailing of notice, addressed to the name and address on the most recent county real estate tax records, shall be deemed a satisfaction of this notice requirement.
      (3)   The required mail notice for applications under this chapter shall contain, at a minimum, the following information:
         (a)   The street address, legal description or detailed location description of the property, if any, that is the subject of the application;
         (b)   A statement describing the name of the subdivision and the number of lots proposed, and other relief proposed;
         (c)   The name and address of the applicant;
         (d)   The name and address of the legal owner, and beneficial owner if any, of the property; and
         (e)   The Plan Commission meeting date, time and location.
      (4)   At the Plan Commission meeting, the applicant shall present to the Commission an affidavit, certification or other evidence satisfactory to the Commission, demonstrating to the satisfaction of the Commission, that the notice requirement of this section has been satisfied.
