(A) The sum of money for which any company, corporation or association is so chargeable under the provisions of this chapter may be recovered of it, or its agent, by action in the name of and for the use of the village as for money had and received.
(B) Nothing in this section exempts any person, corporation, company or association from indictment and conviction under the provisions of any act of the state.
