5-17-3: DEFINITIONS:
For purposes of this chapter, the following words and phrases shall have the meanings respectively ascribed to them by this section:
APPLICABLE LAWS, RULES AND REGULATIONS: Any laws, rules, regulations and codes (whether local, state or federal) pertaining to the use and occupancy of a privately owned dwelling unit as a short term rental.
APPLICANT: The owner of the tourist home or the owner's authorized agent or representative.
APPLICATION FEE: The fee set by city resolution due and payable at the time the operator applies for a short term rental operator permit.
BUILDING OFFICIAL: That person acting in the capacity of the building official of the city of Kellogg or his/her designee.
GOOD NEIGHBOR POLICY AND REGULATIONS: A document prepared by the city that summarizes the general rules of conduct, consideration, and respect, including, without limitation, provisions of this code and other applicable laws, rules or regulations pertaining to the use and occupancy of tourist homes.
LOCAL CONTACT PERSON: The person designated by the owner, or the owner's authorized agent or representative, who shall be available twenty four (24) hours per day, seven (7) days per week while the tourist home is rented, for the purpose of: a) responding within sixty (60) minutes to complaints regarding the condition, operation, or conduct of occupants of the tourist home; and b) taking remedial action to resolve any such complaints.
MUNICIPAL NONPROPERTY TAX PERMIT: A permit issued by the city clerk/treasurer or his/her designee that allows an individual or entity to engage in or conduct the business of renting a tourist home within the city limits pursuant to the provisions of ordinance 574, as it now exists, or as it is subsequently codified or amended.
OPERATOR: The owner or the designated agent or representative of the owner who is responsible for compliance with this chapter with respect to the tourist home. An operator may be an individual, or some other legal entity. An operator may operate one or more tourist homes.
OPERATOR PERMIT: The permit issued by the city of Kellogg that authorizes an operator to manage tourist property(ies) for itself or another. Each operator is required to possess a valid permit; a single permit may cover multiple tourist homes. If the permit is for multiple tourist homes, the application requirements must be met for each tourist home listed under the permit.
OWNER: The person(s) or entity(ies) that hold(s) legal and/or equitable title to the subject tourist home.
PROPERTY: A residential legal lot of record on which a tourist home is located.
RENEWAL FEE: The fee set by city fee resolution which is due annually at the time of renewal required by section 5-17-5 of this chapter.
RESPONSIBLE PERSON: An occupant of a tourist home who is at least twenty one (21) years of age and who is legally responsible for ensuring that all occupants of the tourist home and/or their guests comply with all applicable laws, rules and regulations pertaining to the use and occupancy of the subject tourist home.
SHORT TERM RENTAL OPERATOR PERMIT: A permit that allows the use of a residential dwelling as a tourist home pursuant to the provisions of this chapter, and that incorporates by consolidation a municipal nonproperty tax permit and any other potential licensing required by this code. A short term rental operator permit shall constitute a zoning improvement or business development permit for the purpose of applying these regulations.
TOURIST HOME: A residential dwelling, such as, but not limited to, a single-family detached or multiple-family attached unit, apartment house, bed and breakfast, condominium, cooperative apartment, duplex, or any portion of such dwellings, rented for occupancy for dwelling, lodging, or sleeping purposes for any continuous period not in excess of thirty (30) days.
