(A) New construction and substantial improvement of any commercial, industrial or other non- residential structure shall either have the lowest floor, including basement, elevated to two feet above the level of the base flood elevation; or, together with attendant utility and sanitary facilities, shall:
(1) Be floodproofed so that the structure is watertight with walls substantially impermeable to the passage of water to the level of the base flood elevation. In order to be eligible for lower flood insurance rates, the structures should be floodproofed at least one foot above the base flood elevation;
(2) Have structural components capable of resisting hydrostatic and hydrodynamic loads and effects of buoyancy; and,
(3) Be certified by a registered professional engineer or architect that the design and methods of construction are in accordance with accepted standards of practice for meeting the standards of this subsection. Such certification shall be provided to the official as set forth in § 150.20(C)(3).
(B) In AO zones, new construction and substantial improvements shall either have the lowest floor, including basement, elevated above the highest adjacent grade at least as high as the depth number on the community's Flood Insurance Rate Map (at least two feet if no depth number is specified); or be floodproofed to that level consistent with the floodproofing standards of § 150.67(A)(1), (2), (3), and adequate drainage paths shall be provided around structures on slopes to guide floodwaters around and away from proposed structures.
