ORDINANCE 1995-O-38
ORDINANCE 1995-O-38, ADOPTING AN AMENDED CODE OF ORDINANCES FOR THE VILLAGE OF KELLEYS ISLAND, OHIO, REPEALING ANY AND ALL INCONSISTENT ORDINANCES ADOPTED PRIOR TO AUGUST 10, 1995.
   WHEREAS, American Legal Publishing Corporation has from time to time provided, supplemented, and updated the Ohio Basic Code for the Village of Kelleys Island, Ohio; and
   WHEREAS, due to the repeated supplementing of the code, Council has discovered that confusion has arisen as to some of the provisions contained in the Ohio Basic Code of the Village of Kelleys Island, Ohio; and
   WHEREAS, in response to the confusion regarding the provisions of the Ohio Basic Code, Council has contracted with American Legal Publishing Corporation to prepare a complete codification of all of the ordinances of the Village of Kelleys Island, Ohio, including, but not limited to, the Ohio Basic Code provisions; and
   WHEREAS, American Legal Publishing Corporation has recently completed a review of all of the ordinances enacted by the Council of the Village of Kelleys Island, Ohio, as of August 10, 1995, including, but not limited to, the Ohio Basic Code provisions; and
   WHEREAS, Council, by this ordinance, desires to repeal all inconsistent ordinances adopted by Council, including, but not limited to, any and all inconsistent provisions of the Ohio Basic Code adopted prior to August 10, 1995; and
   WHEREAS, Council, by this ordinance, desires to adopt and implement the complete codification of the ordinances of the village as prepared by the American Legal Publishing Corporation, entitled, Code of Ordinances of the Village of Kelleys Island, Ohio; and
   WHEREAS, Council has further determined that it is necessary to provide for the usual daily operation of the municipal departments, and for the immediate preservation of the public peace, health, and safety, dictates that an emergency now exists and that this ordinance be effective immediately upon its adoption and due authentication by the Mayor and Clerk respectively;
   NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE VILLAGE OF KELLEYS ISLAND, STATE OF OHIO:
   SECTION 1. All inconsistent ordinances adopted by the Council of the Village of Kelleys Island, Ohio prior to August 10, 1995, including, but not limited to, provisions of the Ohio Basic Code be, and hereby are, repealed except as otherwise set forth in the Code of Ordinances of the Village of Kelleys Island, Ohio.
   SECTION 2. The Code of Ordinances of the Village of Kelleys Island, Ohio, as prepared by the American Legal Publishing Corporation, is hereby adopted by the Village of Kelleys Island for immediate use and enforcement hereafter.
   SECTION 3. The Clerk of the Village of Kelleys Island is hereby instructed to file with the official records of the village, the within ordinance, together with a Certification of Posting, and append there to a complete copy of The Code of Ordinances of the Village of Kelleys Island, Ohio being herein adopted.
   SECTION 4. The Code of Ordinances of the Village of Kelleys Island, Ohio being adopted herein shall hereafter be kept on file with the Clerk of the village and shall be made available during normal business hours for inspection by the general public. Copies of it shall be made available by the Clerk to the general public at a charge equal to the cost of duplication.
   SECTION 5. A copy of the Code of Ordinances of the Village of Kelleys Island, Ohio, being adopted herein shall be provided to the Sandusky Bay Law Library Association, the Kelleys Island Public Library, and the Erie County Court for use by the courts and the general public.
   SECTION 6. Council hereby finds and determines that all formal actions relative to the adoption of this Ordinance were taken in an open meeting of the Council; and that all deliberations of the Council and of its committees, if any, which resulted in formal action, were taken in meetings open to the public in full compliance with applicable legal requirements, including R.C. § 121.22.
