Whenever any person, except those employed by Council and under the direction of the Street Commissioner, shall desire to utilize any part of any sidewalk, driveway apron, or drainage ditch, such
person
shall make an application to the Street Commissioner for a permit to do so and shall obtain a surety bond in the amount of $1,000 made payable to the Village of Kelleys Island, Ohio, or deposit the sum of $1,000 with the Clerk. In the event that any damage to any sidewalk, driveway apron, or drainage ditch occurs due to the acts of the person utilizing the sidewalk, driveway apron, or drainage ditch, the bond or cash shall be forfeited to repair any and all damage to any sidewalk, driveway apron, or drainage ditch to its former condition. A violation of this section shall constitute a fourth degree misdemeanor.
