§ 50.53 DELINQUENT PAYMENT; LATE CHARGES; SHUT OFF; NOTICE AND HEARING.
   (A)   Bills for water rates and charges shall be determined by the Board of Public Affairs based upon an actual reading of each customer's meter once each three-month period. Bills shall be issued quarterly on the first day of the month following the reading of the meters. All bills shall be due and payable upon receipt.
   (B)   If any bill for water rates or charges is not paid in full on or before the fifteenth day of the month in which it is issued, the unpaid portion shall draw a late payment charge of a minimum of $25 or a late payment charge of 10% on the amount owed, whichever is greater, which charge shall be added to the bill and become a part thereof on a per month basis. If any bill for water rates or charges, or any portion thereof, shall remain unpaid in full after the twenty-fifth day of the month in which the bill is issued, the water service through the meter upon which the bill was determined may be terminated pursuant to division (C) below.
   (C)   In the event water service is to be terminated pursuant to division (B) above, written notice shall be sent to the customer at the customer's last address known to the Board of Public Affairs. In the event the customer is not the owner of the property connected to the water system, a copy of the notice shall also be sent to the owner of the property, if known to the Board of Public Affairs. Said notice shall be served by mail, personal service or by attaching the notice to the door of the premises so served. Said notice shall inform the customer that, unless the unpaid bill for water rates or charges is paid in full on or before the tenth day following the date of the notice, the water service may be terminated. The notice shall also inform the customer of the right to appeal the termination of water service pursuant to § 50.54. Upon termination, the water supply shall not be resumed until the unpaid portion of the bill, all late charges and a $200 reconnect fee have been paid.
   (D)   In the event a bill for water rates or charges, or any portion thereof, shall remain unpaid after the twenty-fifth day of the month in which the bill is issued, the Board of Public Affairs, regardless of whether water service is terminated, shall do either or both of the following:
      (1)   Certify the unpaid portion together with all late charges to the Erie County Auditor; or
      (2)   Collect the unpaid portion together with all late charges by actions at law.
