6.08.010: DEFINITIONS:
As used in this chapter, unless the context otherwise indicates, the following words and terms shall mean:
ALLOW (OR PERMIT): To permit an act by an animal by neglecting to provide adequate restraint. A person does not have to intend the results of an animal's actions in order to have allowed or permitted.
ANIMAL: Any nonhuman living creature, domestic or wild, male or female, natural or sterilized.
ANIMAL CONTROL OFFICER: Any person designated by the city appointing authority to carry out the provisions of this chapter under the laws of the state of Idaho and the city of Kamiah.
ANIMAL SHELTER: Any premises designated by the city authority for the purpose of impounding and caring for animals held under authority of this chapter.
AT LARGE: To be off the premises of the owner and not under the control of the owner or another person.
DANGEROUS ANIMAL: Any animal of a species or type likely to cause injury to a person, or any animal which has demonstrated a propensity to attack or cause injury to a person.
DOG: Any member, male or female, of the family Canis familiaris.
HARBORING: The occupant of any premises on which an animal remains or to which it customarily returns for food and care, is presumed to be harboring or keeping the animal within the meaning of this chapter.
KENNEL: Includes any place other than a veterinary hospital where three (3) or more dogs are kept or where one or more bitches are kept for breeding and the offspring thereof are sold for profit or given away, or where such animals are received for care and boarding.
LEASH: Shall include a cord, thong, leash or chain not more than six feet (6') in length by which an animal is controlled by the person accompanying it for exercise purposes.
NEUTERED ANIMAL: Includes both male and female dogs rendered incapable of reproducing any offspring.
OWNER, CUSTODIAN OR KEEPER: Any person, firm, association, corporation or partnership, or their agents or persons acting with their permission, owning, keeping or harboring an animal.
POLICE OFFICER: Any employee of the city of Kamiah, the Kamiah marshal's office, the Lewis County sheriff's office, or Idaho County sheriff's office who is hired or charged with the duty of enforcing criminal and/or traffic laws within the city of Kamiah.
PREMISES: All the real property under one's ownership or control inside the inner line of a sidewalk, or, if there is no sidewalk, inside the curb, ditch or shoulder marking edge of the used public right of way. Premises also means the inside of a closed motor vehicle.
SPAYED FEMALE: Includes a female dog which has been sterilized by a licensed veterinarian to avoid or prevent conception.
UNDER CONTROL: The owner or person in charge, by means of a leash, restrains the dog to the owner's, or to the person in charge's immediate proximity, preventing the dog from trespassing upon the property of others, or from annoying or chasing other persons, animals or vehicles of any sort.
VETERINARY HOSPITAL: Any establishment maintained and operated by a licensed veterinarian for the boarding of animals or the diagnoses, treatment and care of diseased or injured animals.
VICIOUS ANIMAL: Includes an animal whose temperament or habits create danger or likelihood of injury to persons or other animals or creates a reasonable apprehension of injury to persons or other animals. (Ord. 98-14 §1, 1998)
