17.04.080: GENERAL PROVISIONS OF TITLE ENUMERATED:
   A.   Agricultural Land: The requirements of this title are intended to be compatible with chapter 45 of title 22 of the Idaho Code (right to farm legislation), and this title shall not be construed so as to deprive the owner of agricultural land of the full and complete use of said land for the production of any agricultural products.
   B.   Allowed Uses: Those uses which by their nature are compatible with existing land uses in the zoned districts of Kamiah are allowed uses. Allowed uses may be established in compliance with the standards and requirements set forth in this title. Allowed uses shall comply with all other city regulations and the laws, regulations and standards set forth by other local, state and federal agencies.
   C.   Building Permits: Any person, firm or corporation desiring to construct, erect, move or remodel a building exceeding one hundred twenty (120) square feet in floor area shall first obtain a permit from the city and shall pay a fee as required by the city.
   D.   Conditional Uses: Conditional uses are those uses which by their nature possess characteristics such as to require review and appraisal by the commission to determine whether or not the use would cause any damage, hazard, or other detriment to persons, property, or natural resources in the vicinity.
   E.   Land Previously Subdivided: Any lot or parcel of land, which was of record on the effective date hereof, which was in conformance with prior subdivision regulations may be used as a dwelling site provided the building placement and health requirements are met and that safe access can be accomplished.
   F.   Nonconforming Uses: No nonconforming use of buildings, structures or land shall be extended or enlarged, except when required by a county or state health officer, and except that any dwelling situated on a nonconforming lot may be enlarged so long as the use does not change and does not violate required setbacks.
      1.   Continuation: The nonconforming use of buildings, structures and land may be continued to the same extent and character as that which exists on the effective date hereof.
   G.   Sewage Disposal And Water Systems: All sewage disposal facilities must be installed and operating before a building shall be occupied. No building shall be occupied as a residence or a commercial, civic, or industrial establishment unless and until an approved and permitted supply of water and sewage disposal system is installed and operating on the premises.
   H.   Lots Below Minimum Space Requirements: After the effective date hereof, no parcel of land which has less than the minimum width and area requirements may be created from a larger parcel of land for the purpose, whether immediate or future, of building or development.
   I.   Sale Or Lease Of Required Space: No space needed to meet the width, yard, area coverage, parking or other requirements of this title for a lot or building may be sold or leased apart from such lot or building unless other space so complying is provided. (Ord. 2007-4, 2007)
