15.04.060: APPEAL FROM ADMINISTRATIVE RULINGS:
Any affected person, agency or organization may appeal a decision made by the building official by submitting, within twenty eight (28) days of the decision, a written request for a public hearing before the city of Kamiah council, an explanation of the grounds for the appeal, and applicable fees. An "affected person" is defined as one having an interest in real property which may be affected by the decision. The final decision on the appeal shall be made by the city of Kamiah council.
Decisions that may be appealed include, but are not limited to, the denial of a permit or certificate of occupancy due to the refusal of a jurisdiction, other than city of Kamiah, to approve the permit or certificate.
The application for appeal shall be based on a claim that the true intent of this building code or the rules legally adopted hereunder has been incorrectly interpreted, the provisions of this building code do not fully apply or an equally good or better form of construction is proposed. The city of Kamiah council shall have no authority to waive requirements of the codes as adopted in this chapter. (Ord. 2010-5 §12, 2010)
