13.04.140: SURPLUS WATER; SUPPLY TO NONRESIDENTS:
The city shall not, under any circumstances, supply a nonresident or a nonresident organization or corporation with other than surplus water. For purposes of this chapter, "surplus water" is defined as follows: That amount of water that exists above the minimum amount necessary for fire protection as shown by the Idaho survey and rating bureau which states that the minimum fire flow for Kamiah should be one thousand seven hundred fifty (1,750) gallons per minute for two (2) hours, or approximately two hundred ten thousand (210,000) gallons. Based on the existing storage of four hundred thousand (400,000) gallons, when the storage tanks drop to half full, the city no longer has surplus water, as of February 17, 1976.
