A. Interference Prohibited: Any person who shall interfere with, molest, injure or destroy any fire hydrant, pipe, main, meter, service box or other appurtenance of the city water system, or shall open any fire hydrant, cap, or make any connection with any water main, lateral or pipe without first obtaining permission from an authorized agent of the city or from the fire department, as the case may be; who shall divert or appropriate water from any hydrant, main, lateral or water pipe, without first paying therefor the charges specified by the code, shall be subject to the penalties set out in this section. It is to be specifically included that no person shall be permitted to adjust, change or turn on any water valve that has been turned off by the city for any reason whatsoever, including, but not limited to, the turning off of the same because of a failure to pay city water bills.
B. Meter Adjustments: Any adjustment whatsoever of a meter shall only be done with the express consent of the city official in charge of the water department. Furthermore, all city water system taps shall be accomplished by the city or under the supervision of the water superintendent.
C. Penalties: Any person doing any of the above prohibited acts shall be subject to a civil penalty of two hundred dollars ($200.00) which shall be accessible and collectible in the small claims division of the district court within the state of Idaho, and in addition thereto, such person shall be subject to a triple charge for all water that can reasonably be proven to have been used after the improper diversion or improper adjustment of any valve. The penalties set forth herein shall be in addition to all other remedies permitted by this code and shall constitute additional sums to which the city would be entitled, a lien, pursuant to this code.
