13.04.040: PAYMENT OF WATER BILLS:
   A.   All utility bills shall be paid to the collector designated by the council on or before the tenth day of the month following the period of service billed. All accounts shall become delinquent at four o'clock (4:00) P.M. on the tenth day of the month if not paid as aforesaid. Whenever any customer becomes delinquent the city clerk shall so notify the owner of the premises by means of the monthly utility billing statement of notice of intent to discontinue water services from the premises to which said services are furnished. Said utility billing statement shall state that water services will be discontinued and will remain cut off until all past due charges, penalties, and fees have been paid. Actual discontinuance of services shall not occur until at least ten (10) days have expired after the utility billing statement has been mailed and shall not occur until the next business day after the tenth day has passed. After the ten (10) days have expired the public works superintendent is then authorized to discontinue service until all fees for water, sewer, and garbage, including any penalties, have been paid.
Upon a discontinuance of service an additional charge of twenty five dollars ($25.00) shall be added for reopening the service in addition to all other costs, penalties, fees and charges herein mentioned.
   B.   In addition, in the event that the service has been discontinued for failure to pay, besides the penalties set forth in subsection A of this section, the city council may in its discretion impose and require a deposit equal to the previous unpaid balance. The deposit thereunder required may then be applied to future potential arrearages should they occur with the same customer.
   C.   In addition, in the event there is any delinquency for the payment of any utility bill, there shall be a penalty set by resolution of the city council of the city of Kamiah per bill that shall be added to each billing and must be paid in addition to all other charges provided in this code.
