8.12.010: DEFINITIONS:
For the purpose of this chapter the following words shall have the meanings respectively ascribed to them:
ABANDONED: To leave a motor vehicle on private property without the permission of the person having rights to the possession of the property, or on a public street or other property open to the public for the purposes of vehicular traffic or parking, or upon or within the right of way of any road or highway, for forty eight (48) hours or longer.
AUTOMOTIVE HOBBY PROJECT: A noncommercial accessory use involving the restoration, maintenance, and/or preservation of motor vehicles taking place exclusively on residential private property within the city limits of the city of Kamiah.
AUTOMOTIVE HOBBY SITE: Any privately owned real property upon which the resident is restoring, maintaining, and/or preserving one or more motor vehicles.
CONTAINER: A garbage can, dumpster, or any other kind of storage device customarily sold, rented, constructed, or utilized for use as temporary storage of waste matter, and lawfully located on the property in question.
FRONT YARD: All property, including driveways and entranceways extending between side lot lines across the frontage of a lot adjoining a public street other than an alley, and from any side of the principal building.
HAZARDOUS WASTE: A. Any "hazardous waste" as defined by the resource conservation and recovery act of 1976 (42 USC section 6901 et seq.), as amended from time to time, and regulations promulgated thereunder;
   B.   Any "hazardous substance" as defined by the comprehensive environmental response, compensation and liability act of 1980 (42 USC section 9601 et seq.), as amended from time to time, and regulations promulgated thereunder;
   C.   Radon and material quantities of petroleum products;
   D.   Any substance the presence of which on the property is regulated by any federal, state or local law relating to the protection of the environment or public health; and
   E.   Any other substance which by law requires special handling in its collection, storage, treatment or disposal.
HIGHWAY: A way or place of whatever nature, publicly maintained and open to the use of the public for purposes of vehicular travel or parking. Highway includes street or alley. Highway does not include those portions of said way or place which are not utilized for vehicular travel, such as those portions of aprons, setbacks, easements, rights of way, or property owned by the public which extend beyond the surface area normally utilized for vehicular travel or parking. Said areas are to be considered public property for purposes of this chapter.
INOPERATIVE: A vehicle that is incapable of being propelled under its own power or operation.
PUBLIC PROPERTY: All property owned by the public. Public property does not include a highway.
REAR YARD: A yard extending between side lot lines across the rear of a lot opposite the side(s) of a building which fronts upon a public street and from the rear lot line to the principal building.
VEHICLE: A device by which any person or property may be propelled, moved, or drawn, whether or not utilized solely upon a highway, except a device moved solely by human power or used exclusively upon stationary rails or tracks, whether or not in a condition capable of operation or use.
WASTE MATTER: Any kind of liquid or solid waste, hazardous waste, manufactured goods, appliance, fixture, furniture, machinery, vehicle, personal property or any other thing or part thereof, whether of value or valueless, that is demolished, discarded, dismantled, partially dismantled, dilapidated, or so worn, deteriorated, or in such a condition as to be generally unusable and/or inoperable in its existing state. This shall include, by way of illustration only and without limitation, trash or refuse of any kind, litter, commercial waste, industrial or construction or demolition debris of any kind, such as rubble, broken asphalt and concrete, crates, cartons, metal, glass, appliances or appliance shells, boat bodies and parts, used tires, vehicle bodies and parts, commercial or industrial equipment bodies and parts, snowmobile bodies and parts, trailers and parts, recreational vehicle bodies and parts, mobile home and manufactured home bodies and parts, and inoperable or damaged vehicles of any kind, and any castoff tangible personal property or fixtures.
