8.08.100: RATES:
   A.   There shall be a per month fee, which shall be set by resolution of the council, for garbage disposal service for each individual resident, and in the case of an apartment or trailer house, each separate apartment or trailer house will be considered as an individual unit for the purpose of this chapter. There shall be a per month fee, which shall be set by resolution of the council, for garbage disposal service for all businesses using the standard two (2) garbage cans per week pick up not otherwise contractually agreeing for dumpster service. There shall be a per month fee, which shall be set by resolution of the council, for garbage disposal service for pool halls, taverns, bars, cafes, grocery stores and service stations and said charges will be added to and be included within the monthly billing of water rates.
Concerning any building which houses multiple businesses or multiple independent tenants, the owner or contract purchaser of that building and real estate shall be charged the regular fee described in this section for each independent business.
   B.   The deeded owner or property purchaser must, as a condition of receiving continued service, sign an agreement with the city of Kamiah to be responsible for the bill for garbage services, even if the property is rented to another. Owners who live out of state or out of the Kamiah area may appoint an agent to act on his/her behalf for purposes of entering into said agreement with the city of Kamiah.
   C.   In the event payment for garbage services is made by check, and the check be returned or dishonored for any reason, the city may, as a condition of continuing water service to the property of the maker of said check, collect from said maker any bank charges made by said bank against the city of Kamiah for handling or processing said check or checks.
   D.   For all unpaid charges, the city shall be entitled to file a lien in the county auditor's office where the services are provided. Lien filing and foreclosure may be joined with actions for other unpaid utility services, pursuant to section 13.04.080 of this code.
   E.   Of the charges herein specified for the collection of garbage rates, the city shall be entitled to the sum of eleven percent (11%) of each garbage bill per month.
   F.   For any business or other individual desiring separate dumpster and commercial containers, those rates shall be specially negotiated between the entity desiring service, and the sanitation contractor, based upon rates that shall be filed with the city and available for public inspection. In the event of any dispute arising over the reasonableness of rates, or any dispute arising between any commercial customer and the sanitation contractor, that dispute shall be submitted to arbitration by the city council, and the city council's ultimate decision shall be final in such dispute. The city rates and those billings shall be separate and apart from those billings herein mentioned.
   G.   For each separate business that may be housed within an independent building, or for each apartment or trailer unit that might be on independent real estate, all of these separate charges shall be billed to the property owner or contract purchaser as otherwise provided in this chapter, and such property owner shall have the liabilities specified in subsection A of this section.
   H.   The city council is hereby authorized in its discretion by appropriate motion or resolution to enter into contracts with refuse removal companies for the removal of solid waste and recyclables as from time to time shall be necessary and expedient for the city. Within any such contracts the terms of this title shall be incorporated where necessary.
   I.   When service is provided for less than a full month, the charges for service shall be prorated on a daily basis.
