The following words and terms shall, for the purposes of this chapter and as used elsewhere in this code, have the meanings shown herein:
Beer Garden: An outside, open area for patrons of a licensed establishment, to sit down and drink alcoholic beverages purchased inside, where access in and out of the beer garden is restricted and permitted only from the interior of the premises, or by a monitored entrance into the beer garden from outside the premises. Only alcoholic beverages sold inside the premises may be consumed in the beer garden.
Building Inspection: A review of all stage, platform, tent, canopy, and other temporary installations associated with the special event, and all other building inspections not specifically provided for herein, by the village building inspector.
Canopy: A structure, enclosure or shelter constructed of fabric or pliable materials supported by any manner, except by air or the contents it protects, and is open without sidewalls or drops on seventy-five percent (75%) or more of the perimeter.
Carnival: An enterprise which offers amusement or entertainment to the public by means of one (1) or more amusement attractions or. amusement rides as defined by the Illinois Department of Labor, Carnival and Amusement Rides Safety Act (the Act) [430 ILCS 85/2-2]. No amusement ride or attraction shall be operated for public use at a carnival or fair/ festival in the State of Illinois without a permit having been issued by the Director of the Illinois Department of Labor to the owner of such equipment. Annual inspections are required of an amusement ride or amusement attraction and are performed by the Director or the Director’s designee.
Dangerous Acts: Any act which endangers the public health or results in discomfort to the public. Discharging fireworks without a license and supervision of the fire chief or his or her designee is considered a Dangerous Act.
Electrical Inspection: A review of temporary electrical installations, underground or overhead wires and apparatus, generator connections, and all other electrical inspections not specifically provide for herein, by the village electrical inspector.
Fireworks Exhibitions: A public exhibition of fireworks and pyrotechnics for which a license is granted by the village board and are subject to the supervision of the fire chief or of some person designated by him or her.
Health Inspection: A review of all temporary food service establishments and all other health inspections not specifically provided for herein, by the village health inspector.
Liquor License, Temporary Event: A special event liquor license issued by the liquor commissioner for the sale or distribution of beer and wine only consistent with section 3-101 of the Justice Municipal Code,
Noise: A boisterous nature, that disturbs or destroys the peace of the neighborhood in which a building or
premises is situated; the operation or playing of a phonograph, radio, loudspeaker, musical instruments (band) or other device or instrument whereby sound is amplified, during the hours from seven o’clock (7:00) P.M. to seven o’clock (7:00) A.M. of the next following day, in such manner or with such volume that the sound caused thereby is audible to human beings beyond a distance of four hundred feet (400') and beyond the premises whereon the same is operated or played.
Outdoor Stage: A stage with surface areas greater than one thousand five hundred square feet (1,500 ft2) erected or constructed outside of a building or otherwise located so as to be exposed to the effects of wind and weather.
Platform: A raised area used for entertainment, deliberation, worship, amusement, ceremonies or similar uses. Platforms do not incorporate any overhead lighting, hanging curtains, drops, hanging scenery or other overhead stage effects or equipment. Raised areas used for seating, tables, lectures, presentations, boxing and wrestling rings, theaters-in-the-round and similar uses are examples of Platforms as long as there is no overhead lighting, hanging curtains, drops, hanging scenery or other overhead stage effects.
Plumbing Inspection: Review of all temporary potable water connections, meters, and backflow devices, locations of temporary toilet and hand washing facilities and all other plumbing inspections not specifically provided for herein, by the village plumbing inspector,
Potable Water: Water which is fit for consumption by humans and other animals, also known as drinking water based on its intended use. Water shall be obtained for an Illinois Environmental Protection Agency approved and regulated system or from another source approved by the village health inspector. Devices shall be provided to protect against back flow and back siphonage to protect the water supply and shall be constructed in accordance with the Illinois Plumbing Code (77 Ill. Adm. Code 890).
Security Personnel: Any personnel, being a minimum of twenty-one (21) years of age, performing armed or unarmed security, crowd control, traffic control or other types of security at and during special events.
Special Event: A unique event such as but not limited to public shows, theatricals, circuses, fairs, festivals, carnivals, runs, parades, block parties, concerts, musical entertainment performances, car shows, fire works exhibitions, temporary food service events, and other amusements in the village, held at a particular location.
Stage: means a space used for entertainment, deliberation, worship, amusement, ceremonies or similar uses utilizing overhead lighting, hanging curtains, drops, hanging speakers, hanging scrims, hanging scenery or other overhead stage effects or equipment. These rules are applicable to outdoor stages with surface areas greater than one thousand five hundred square feet (1,500 ft2).
Temporary Food Service Establishment: Any food service establishment, that operates at a fixed location for a period of time not to exceed fourteen (14) consecutive days in conjunction with a single special event or celebration.
Tent: A structure, enclosure or shelter constructed of fabric or pliable material supported by any manner except by air or the contents that it protects.
