1260.074   HOD-CC HISTORIC OVERLAY DISTRICT – CAMBRIA CITY.
   (a)   Purpose. It is the purpose of the Historic Overlay District – Cambria City to create, sustain, and promote the general welfare of residential properties, economic prosperity, and recreational pleasure of the public through the preservation and enhancement of those buildings, structures, places, landscapes, and areas that have historical, cultural, and architectural significance. Regulations within said HOD-CC District are intended to protect against the destruction of or encroachment upon such areas, structures, and places; to encourage uses which will lead to the continuance, conservation, and improvement of the Cambria City neighborhood as listed in the National Registration of Historic Places (1991) in accordance with the following purposes:
      (1)   To preserve and improve the quality of life for residents of the district by protecting and preserving familiar visual elements of the district;
      (2)   To promote tourism by protecting heritage, cultural, and religious resources which are attractive to visitors of the district and hereby supporting local businesses and industry;
      (3)   To promote the upkeep and rehabilitation of significant older structures and encourage appropriate land-use planning and development what will enhance both the economic viability and historic character of the district; and
      (4)   To ensure that new development within the district is appropriate to the scale, usage, and build fabric of the district.
   (b)   Permitted Uses. In the HOD-CC Historic Overlay District – Cambria City, the land and structures within may be used, and structures may be erected, altered, enlarged and maintained for the following uses only:
      (1)   Single-family detached dwellings.
      (2)   Two-family duplex or two-single family units on one lot.
      (3)   Town homes with not more than four units in a continuous row.
      (4)   Gardening and the growing of trees.
      (5)   Commercial and/or retail establishments with a gross display area not to exceed 1,000 square feet, including but not limited to: antique shop, art gallery/studio, hair styling salon, bookstore, convenience/grocery store, florist, hobby/craft/gift shop, pet shop, pharmacy, and other similar type of usages approved by the Planning Commission.
      (6)   Eating (sit-down) and drinking establishments with an area not exceeding 1,000 square feet.
      (7)   Offices for commonly recognized professions not to exceed 1,000 square feet, including those for accountants, attorneys, physicians, dentists, chiropractors, engineers, optometrists, consultants and other similar type of usages approved by the Planning Commission.
      (8)   Parks, playgrounds, and recreation areas not to exceed 5,000 square feet of built play area, under either public or non-profit ownership.
      (9)   Clubs and social halls.
      (10)   Churches/places of worship.
      (11)   Bed and breakfast inns.
      (12)   Cultural facilities and/or performing arts centers such as art galleries, auditoriums, museums, and commercial or educational institutions offering instructions in dance, music, art, drama and the like.
      (13)   Home-based occupation – minor impact.
      (14)   Accessory buildings, parking lots, and uses on the same lot that are customarily incidental to and/or required for the above usages.
   (c)   Uses by Special Exemption. The following uses may be permitted by special exemption by the Zoning Hearing Board, which may make approvals subject to conditions to be met and maintained by the applicant:
      (1)   The demolition of a structure or portions of a structure for the reuse and/or development into a permitted usage not of the original structure.
      (2)   Home-based occupation – major impact.
      (3)   Community parking areas.
      (4)   Permitted uses in paragraph (b)(5), (b)(6), and (b)(7), for areas in excess of the square footage designated.
   (d)   Setback Specifications. The setback of buildings shall be provided in accordance with provisions of Appendix C.
   (e)   Mass/Height Specifications. The mass/height of buildings shall be provided in accordance with provisions of Appendix D.
   (f)   Off-street Parking. Parking for all new construction and/or development shall provide the minimum amount needed and/or as prescribed by the Planning Commission. The re-use of existing buildings will be allowed with the parking as it exists, no additional parking shall be required or mandated.
   (g)   Signs. Signs shall be provided in accordance with provisions of Sections 1260.100 through 1260.106 .
   (h)   Other Provisions. All commercial storefronts and/or mixed-use structures shall be maintained as per the regulations set forth in Section 1260.120 , Standards for Storefronts and Windows.
