The terms as used hereinafter shall have the following definitions:
(a) “Accessory use” means a building or use customarily incidental and subordinate to the principal building or use and located on the same lot of record with the principal building or use, in accordance with the City Zoning Ordinance (Part 12, Title 6).
(b) “Applicable rules” means the most current version of “Rates, Rules and Regulations for Johnstown Regional Sewage Regarding the Use of the Sewage Collection or Treatment Systems” which have been formally adopted by the Board of the Redevelopment Authority of the City of Johnstown, and notice of which adoption has been provided to each municipality. The applicable rules shall include all exhibits to the rules.
(c) “Approval authority” means the United States Environmental Protection Agency or other governmental agency authorized to review and approve the JRS's industrial pretreatment or other source control program.
(d) “Approved pretreatment program” means a program for pretreatment of industrial waste approved by the Environmental Protection Agency or the Department of Environmental Resources in accordance with the Federal Water Pollution Control Act, 62 Stat. 1155, 33 U.S.C. § 1251 et seq.
(e) “Enforcement Response Program” means the Enforcement Response Program as approved by the US EPA and provided to the Municipality by the JRS.
(f) “Governing body” means the City Council of the City of Johnstown.
(g) “JRS” means Johnstown Regional Sewage, an enterprise operation of the Redevelopment Authority of the City of Johnstown, and operating as and fulfilling the functions of PWTA - public wastewater treatment authority, and POTW, publicly owned treatment works as referred to in applicable State and Federal laws and regulations.
(h) “Local limits” mean limitation on concentrations and absolute volumes of contaminants introduced into the sewage collection system.
(i) “Lot of record” means a designated parcel, tract or area of land established by plat, subdivision, deed, contract, or as otherwise permitted by law, as duly recorded in Cambria County property records, to be used, developed or built upon as a unit.
(j) “Municipality” means the City of Johnstown, Cambria County Pennsylvania.
(k) “Occupancy” means the use or intended use of a building or part thereof either through ownership or lease.
(l) “Principal use” means the main, primary or predominant use of land or structures, as distinguished from a secondary or accessory uses, in accordance with the City Zoning Ordinance (Part 12, Title 6).
(m) “Private sewer facilities” mean sewer facilities owned and maintained by the property owner including building drains, cleanouts and laterals from the structure to the public right-of-way.
(n) “Public collection/interceptor system” means publicly-owned and maintained sewer facilities, including:
(1) “Sanitary collection lines.” Sanitary sewer lines owned and maintained by the City, or other municipality or authority served, collecting wastewater from tributary lateral sewers and other sanitary sewer collection lines and conveying wastewater to the interceptor lines.
(2) “Sanitary interceptor lines.” Sanitary sewer lines owned and maintained by JRS, collecting wastewater from tributary collection and lateral sewers and conveying wastewater to the publicly-owned wastewater treatment plant (POTW).
(o) “Public Works Department” means the Director of the Public Works Department of the City of Johnstown, or his or her designee.
(p) “Sewage Compliance Officer” means the municipally authorized representative appointed by the City Manager, from time to time, whose duty it shall be to administer requirements pertaining to the sanitary sewer system in Part Ten, Streets, Utilities and Public Services Code, Title Four, Utilities, of the Codified Ordinances unless such duty is expressly conferred upon another municipality, official or entity.
(q) “Storm sewer system” means the publically-owned and maintained system of pipes and/or open channels that collect, convey and discharge stormwater generated from precipitation or snow/ice melt events that may be transmitted from roofs, collection inlets, basement floor drains and impervious areas from properties within the City, excluding sanitary sewer flows and industrial wastes.
(r) “Stormwater” means drainage runoff from the surface of the land resulting from precipitation or snow or ice melt.
