1040.01 UTILITY FRANCHISE FEES.
   (a)   Definitions. As used in this section:
      (1)   "Lineal foot" means a lineal or running foot of wire, pipe or other means of transmission installed within the City.
      (2)   "Transmission line" means a pipe, conduit, wire or other means of carrying the service of a particular entity.
      (3)   "Utility" means gas, electricity, telephone, water and sewage service.
      (4)   "Utility company" means those companies, corporations or other bodies which provide the services listed.
   (b)   Rate. The providers of utility services shall be charged for the extension of such services at the rate of one dollar ($1.00) per lineal foot of pipe, wire, conduit or other means of transmission installed. The fee shall be imposed for the year 1981, beginning January, 1981, and each year thereafter.
   (c)   Time of Payment. The utility franchise fee imposed hereby shall be payable on or before the commencement of the installation. For those lines already installed, the fee shall be payable on or before March 31, 1981. There is hereby imposed a penalty of one-half of one percent per month on all fees paid after March 31, 1981.
   (d)   Collection of Fees. The fee charged hereunder shall be paid to the Director of Finance on or before the date set forth in subsection (c) hereof. The fees charged hereunder shall be a lien on the property of the company when properly filed in the office of the Prothonotary and may be collected in the manner provided by law for the filing and collection of municipal claims, or by a civil action in assumpsit, at the option of the City.
