852.04   PERMITS FOR SALES.
   (a)   Permits for Permanent Businesses Located Within the Festival Designated Area.
      (1)   Any City merchant that is regularly engaged in business in the City and is located within the designated festival area, is permitted to engage in outdoor or indoor sales within the confines of their business or on the permitted sidewalks right-of-way areas abutting his business premises, without a permit, provided that the merchant is selling merchandise they own.
      (2)   A City merchant will not be required to obtain a permit to engage in outdoor sales of merchandise in any yard or parking area of the merchant's property, provided that the merchant owns the merchandise. The merchant must provide the City with a drawing showing the layout of the outdoor area to scale along with listing the type of items for sale.
   (b)   Permits for Property Owners Within the Festival Designated Area. It shall be unlawful for any person to rent, sell, or provide indoor or outdoor space to a vendor for the sale of food or merchandise without a permit during any special event or celebration approved by the City. Any property owner wishing to rent, sell, or provide indoor or outdoor space to a vendor must obtain a permit for each individual vendor in the indoor or outdoor festival area and pay a participation fee to the event operator/promoter. The required participation fee shall be established by ordinance of City Council and amended from time to time. The property owner must provide to the City a scale drawing of the layout of the leased space along with a certificate of insurance listing coverage. Insurance coverage must include comprehensive general liability insurance in an amount not less than one million dollars ($1,000,000) naming the City and the event operator/promoter of the special event or celebration as additional insured's during the said event or celebration.
   (c)   Permits for a City Resident. A City resident may engage in a garage sale, yard sale, tag sale, or porch sale with a permit provided that all merchandise is owned by said resident and no food and/or beverages are sold.
