690.04   PROHIBITED HUNTING AREA.
   (a)   Intent and Purpose. City Council has enacted this section to protect the safety of its citizens and minimize the damage to City owned property.
   (b)   Definitions. As used in this section, the following terms shall have the meaning indicated in accordance to Title 34 of Pennsylvania Code § 131.2 which establishes hunting as the taking of any wildlife without first obtaining required hunting or furtaker licenses by any type of firearm or device capable of killing wildlife as is established under the Pennsylvania Game and Wildlife Code.
   (c)   Regulations and Restrictions.
      (1)   It is unlawful to hunt or discharge a firearm or other device capable of killing wildlife, on, or across land in the area known as the hillside of the Johnstown Inclined Plane. This shall include all wildlife either protected or unprotected according to Title 34 of the Pennsylvania Code § 133.
      (2)   It is unlawful to hunt for, shoot at, trap, take, chase, or disturb wildlife within 150 yards moving to or from the area know as the hillside of the Johnstown Inclined Plane.
      (3)   It is unlawful to shoot into the area know as the hillside of the Johnstown Inclined Plane, even if you are outside of this specified zone.
      (4)   Driving game, even without a firearm or bow, out of the specified zone without permission, is unlawful.
      (5)   The prohibition of hunting within the specified zone applies to all hunters and furtakers, including big game hunters, small game hunters, archery hunters and muzzleloader hunters, and all individuals defined as being a hunter or furtaker under the Pennsylvania Game Commission and Wildlife Code.
   (d)   Violations and Penalties. Violation of the provisions of subsection (c) hereof is punishable by a fine of up to two hundred fifty dollars ($250.00). A second or subsequent violation of subsection (c) hereof is punishable by a fine of up to three hundred dollars ($300.00) and the loss of hunting privileges for a period of twelve months from the date of the violation.
   (e)   Enforcement. This section is enforceable by Pennsylvania Game Commission officers, by Sheriffs and Deputy Sheriffs, and by other peace officers with general subject matter jurisdiction.
   (f)   Responsibility of Sportsmen. Sportsmen are responsible for knowing the rules and regulations that govern the lands they intend to hunt or trap.
