614.32 RULES AND RESTRICTIONS FOR THE PRESENCE OF DOGS IN CITY PARKS AND PLAYGROUNDS.
   (a)   (1)   Dogs are prohibited, whether running at large or restrained, from all City-owned parks and/or playgrounds within the corporate limits of the City other than those specifically identified and designated in this section.
      (2)   Dogs are permitted to be present within three City-owned parks:
         A.   Morley's Dog Park located at the intersection of Main and Market Streets in Downtown Johnstown.
         B.   Memorial Park located at the intersection of Market and Main Streets in Downtown Johnstown.
         C.   Designated area located south of Park Drive in Roxbury Park.
   (b)   Dog owners are subject to the following rules and restrictions:
      (1)   All dogs must be leashed and maintained under control of the dog's owner, custodian, and/or keeper at all times.
      (2)   The leash of any dog cannot exceed a maximum of six feet in length.
   (c)   Any dog owner, custodian, and/or keep who fails to have his/her dog leashed while in these three designated City parks will be charged and assessed a monetary fine of one hundred dollars ($100.00) per occurrence.
   (d)   Any dog owner, custodian, and/or keeper who fails to clean up waste from their dog within these three designated City parks will be charged and assessed a monetary fine of three hundred dollars ($300.00) per occurrence.
   (e)   Any dog owner, custodian, and/or keeper whose dog injures any other dog or person while these three designated City parks will be charged and assessed a monetary fine of five hundred dollars ($500.00). The dog's owner, custodian, and/or keeper and any other person shall be prohibited from bringing the dog inflicting such injury to, in, or on any/all City parks or playground property from the date of the incident forward.
   (f)   Service dogs used to assist disabled individuals shall be granted reasonable exemptions from the provisions of this section where the need for such exemption is related to the service/assistance provided by the dog to the disabled individual to whom the dog provides service. A determination of whether exemption applies shall be based on the individual circumstances of each case and afforded as an accommodation absent the imposition of any threat to public safety.
