482.14 PARKING OF TRAILERS AND SPECIAL MOBILE EQUIPMENT.
   (a)   Definitions. Unless the context otherwise requires, the following words or phrases shall be construed according to the definitions set forth below:
      (1)   “Special mobile equipment” means vehicles not designed or used primarily for the transportation of persons or property, and only incidentally operated or moved over a highway, including, but not limited to, ditch-digging apparatus, well-boring apparatus, earthmoving and construction and maintenance machinery such as asphalt spreaders, bituminous mixers, bucket loaders, snowplows, ditchers, graters, finishing machines, road rollers, scarifiers, earthmoving carry-alls, scrapers, power shovels, and draglines, and self-propelled cranes and tractors other than truck tractors.
      (2)   “Trailer” means a vehicle designed to be towed by a motor vehicle, including, but not limited to, box trailers, flatbed trailers, boat trailers, truck campers, full trailers, semitrailers, modular housing undercarriages, mobile homes, and utility trailers.
   (b)   Violations.
      (1)   Trailers. No person shall park any trailer on any street, alley, or highway within the City that is not appropriately attached to an undertow by a motor vehicle.
      (2)   Special mobile equipment. No person shall park any special mobile equipment on any street, alley, or highway within the City that is not engaged in or about to be engaged in or about to be engaged in active construction work either on the roadway or other construction site.
      (3)   It shall be a violation of this section and a summary offense for any person, corporation, or other entity to close or materially impede the traffic on any City highway or byway, including alleys, without first providing 48 hours' notice to the City of Johnstown Public Works Department and securing the approval of the designated head of that department. Violators of this section shall be cited and instructed by appropriate personnel to dispense immediately with the obstruction.
   (c)   Exceptions. Provided, however, that the provision of division (b) of this section shall allow for the temporary parking of said defined trailers and special mobile equipment for emergencies or emergency repairs for a period of not longer than one hour, subject to all other prohibitions, regulations, or limitations imposed by traffic regulations of the City of Johnstown Traffic Code and any other ordinances of the City.
   (d)   Removal. Upon official notification by the City of a violation of this section, the owner will remove said trailer or special mobile equipment in violation from the street, alley, or highway within 24 hours. If the trailer or special mobile equipment has not been removed, and the owner has not shown cause for a time extension, the City shall move or cause to be removed at the owner's expense said equipment in violation to a suitable facility, where it may be reclaimed by the owner upon payment of costs.
   (e)   Enforcement. It shall be the duty of the Captain of Police Operations of the City of Johnstown Police Department or an officer of the City of Johnstown Police Department to enforce the provisions of this section.
   (f)   Violations and Penalties. Violations of this section shall be punishable by a fine of not less than three hundred dollars ($300.00) nor more than one thousand dollars ($1,000) or imprisonment not exceeding 90 days, or both. Each day that the blockage continues shall constitute a separate violation of this section.
