294.20 RESIDENCY REQUIREMENTS.
   (a)   For newly hired employees of the City hired after April 29, 2013, the City Council directs the administration to make every attempt to fill all vacancies with City residents.
   (b)   The City Council has decided that preference be given to City residents when vacancies are being filled with the City.
   (c)   Proof of Residency and of Continuous Residency. When an applicant to a position wishes to use the residency preference option in the hiring process, they must be able to produce one of the following items for proof:
      (1)   Valid Commonwealth of Pennsylvania driver’s license;
      (2)   Valid voter registration identification;
      (3)   Proof of filing the required local income tax returns (Central Tax Bureau);
      (4)   Property tax receipts for addresses listed on employment records/application; or
      (5)   A fully executed affidavit from owner or manager of rental unit where employee indicates a City of Johnstown address or domicile.
   (d)   Affidavit. All employees at the time of appointment/hiring shall be required to execute a sworn affidavit attesting to acknowledgment of the residency requirements as contained in this section.
   (e)   Collective Bargaining Agreements.
      (1)   Certain provisions contained in collective bargaining agreements with the personnel of the Johnstown Fire and Police Departments have been awarded/given non-residency status and are not subject to change by the enactment of this section.
      (2)   The City will seek to have all new hires in Police and Fire Departments to be in compliance under provision of this section in future collective bargaining negotiations and/or arbitrations.
