CHAPTER 262
Authorities
   EDITOR'S NOTE: This chapter has been established to provide a synopsis of legislation relating to the creation of the following authorities serving the City:
Johnstown Housing Authority. Pursuant to House Bill No. 753, Act 265, 1937, Resolution 2727, passed March 5, 1940, declared the need for a housing authority to function within the territorial limits of the City for the purposes designated in such Act. An unnumbered resolution of the Board of County Commissioners, passed November 30, 1949, declared the need for the Johnstown Housing Authority to function in a portion of the limits of Stonycreek Township.
Johnstown Parking Authority. Under the provisions of the Act of June 5, 1947 (P.L. 458), as amended, the Johnstown Parking Authority was created by Ordinance 2923, passed September 19, 1950, as amended by Ordinance 2925, passed October 10, 1950. Ordinance 4154, passed September 26, 1979, extended the term of existence of the Authority for fifty years from that date.
Greater Johnstown Water Authority. Under the provisions of the Act of May 2, 1945 (P.L. 382), as amended, the Greater Johnstown Water Authority was created by Ordinance 3566, passed August 16, 1963. Resolution 7661, passed February 9, 1983, approved amendments to the Articles of Incorporation of the Authority.
Redevelopment Authority. Under the provisions of the Act of May 24, 1945 (P.L. 991), as amended, the Redevelopment Authority of the City was created by Resolution 3767, passed November 29, 1949.
Johnstown Municipal Authority. Under the provisions of the Act of June 28, 1935 (P.L. 463), as amended, the Johnstown Municipal Authority was created by Ordinance 2251, passed September 27, 1938, and by Ordinance 2312, passed August 27, 1940. Resolution 5139, passed March 22, 1960, authorized the Authority to amend its Articles to increase its membership from five to nine. Resolution 5524, passed December 5, 1961, authorized an amendment to decrease the membership from nine to seven.
Cambria/Somerset Recycling Authority. Under the provisions of the Act of May 2, 1945 (P.L. 382), as amended, the Cambria/Somerset Recycling Authority was created by Ordinance 4540, passed August 8, 1990.
   Ordinance 4654, passed October 27, 1993, provides that the above-listed authorities in existence prior to the effective date of the Home Rule Charter shall continue to serve and act subject to all provisions of applicable State, Federal and local laws, ordinances and regulations. The existing members of the boards of such authorities shall continue to serve their specific terms until removal by specific Council action.
   Any ordinance relating to operations of the above-mentioned authorities which is in conflict with any provision of the Home Rule Charter shall be amended within forty-five days of the effective date of the Home Rule Charter.
