If a vacancy shall occur in the office of a Councilmember for any reason, the remaining members of the Council shall fill such vacancy until the next Municipal election by appointing a person qualified to hold such office. If the Council shall refuse, fail, neglect, or be unable, for any reason whatsoever, to fill such vacancy within forty-five (45) days after the vacancy occurs, the Court of Common Pleas shall, upon petition of the Council or of any five (5) electors of the Municipality, temporarily fill the vacancy by the appointment of a qualified resident of the Municipality who shall serve until a successor is elected and seated following the next Municipal election.
