(a) Mandatory water use restrictions for all parties connected to the water system of the Village shall consist of three phases. The Utilities Director shall be authorized to implement these restrictions according to the following guidelines.
(b) The following Phase I mandatory water use restrictions shall go into effect after the fifth consecutive day of water consumption of 400,000 gallons per day or more:
(1) Fire Department car washing, water hauling and non-essential use shall be prohibited.
(2) Fire Department fire fighting practice involving water usage shall be prohibited.
(3) Filling of private swimming pools shall be prohibited.
(c) The following Phase 2 mandatory water use restrictions shall go into effect after the third consecutive day of water consumption of 450,000 gallons per day or more:
(1) Bulk water sales shall be limited to the sale of water to be used for drinking and household uses only.

(2) Watering of residential yards and gardens and use of residential water service for the washing of automobiles and other motor vehicles shall be prohibited.

(d) The following Phase 3 mandatory water use restrictions shall go into effect after the third consecutive day of water consumption of 490,000 gallons per day or more:
(1) All sales and hauling of bulk water shall be prohibited.
(2) Industrial, commercial and other high volume water users shall be required to restrict water usage up to fifty percent (50%) as directed by the Utilities Director.
(e) Any restrictions imposed by this section shall remain in effect until removed by the Utilities Director .

(f) Violations of these water use restrictions shall result in the following actions and penalties:
(1) First violation: Oral warning delivered by the Department of Utilities.
(2) Second violation: Written warning delivered by the Police Department.
(3) Third violation: Whoever violates this section after receipt of the two warnings set forth in subsection (e)(1) and (2) above shall be guilty of a minor misdemeanor. Each occurrence of violation of these restrictions after receipt of the warnings specified in subsection (e)(1) and (2) above shall constitute a separate violation.
(4) Fourth violation: Termination of water service to the property at which the violation occurred. Termination of such service shall subject the violator to the turn-on fee provided in Section 921.11. Provided, however, no person shall be charged with a fourth violation of this section until such time as such person has been found by a Court of competent jurisdiction to have been guilty of one or more third violations of this section.
(5) Subsequent violations: Same penalty as (f)(4) above.
