194.99 PENALTIES.

   (a)   (1)   Except as otherwise provided herein, a violation of Section 194.90(a), (b), or (d) shall be a minor misdemeanor as defined in Chapter 501 of the Codified Ordinances. The court shall sentence the offender to a fine of not less than fifty dollars ($50.00) for each violation.

      (2)    If the offender has previously been convicted of or pleaded guilty to a violation of Section 194.90(a), (b), (c), or (d), a violation of Section 194.90 (a), (b), or (d) shall be a misdemeanor of the third degree as defined in Chapter 501 of the Codified Ordinances. The court shall sentence the offender to a fine of not less than one hundred dollars ($100.00) for each violation.

   (b)   (1)   Except as otherwise provided herein, a violation of Section 194.90(c) shall be a misdemeanor of the third degree as defined in Chapter 501 of the Codified Ordinances. The court shall sentence the offender to a fine of not less than one hundred dollars ($100.00) for each violation.

      (2)    If the offender has previously been convicted of or pleaded guilty to a violation of Section 194.90(a), (b), (c), or (d), a violation of Section 194.90(c), shall be a misdemeanor of the first degree as defined in Chapter 501 of the Codified Ordinances. The court shall sentence the offender to a fine of not less than two hundred dollars ($200.00) for each violation. (Ord. 50-2021. Passed 12-14-21.)
