941.05 CONTAINERS.
   (a)   No owner, tenant or lessee of any public or private premises shall permit to accumulate on his premises any solid waste unless it is placed and maintained in containers as provided herein.
   (b)   Residential. All residential properties in the Village shall be provided a toter by the company or firm designated by Village Council as the exclusive franchisee or licensee, which shall be used to hold the accumulation of solid waste. All containers shall be kept covered at all times.
   (c)   Commercial Containers. Subsection (a) hereof shall not apply to commercial and manufacturing establishments which shall use a container of such size or type that shall permit the refuse to be easily handled. Subsection (a) hereof shall apply to all containers used for the collection and storage of solid wastes created incident to the use, preparation and storage of food for human consumption. All containers shall be constructed with covers so that the solid wastes stored therein cannot be scattered.

   (d)    Solid wastes, including newspapers, that are larger than can be contained in containers shall be securely tied in bundles not to exceed forty pounds in weight. Parts of trees or shrubs shall not exceed three feet in length and eighteen inches in diameter.
   (e)    Container Location. All containers shall be set out at the nearest curb or alley on collection days at an easily accessible place on the premises in plain view.
