For the purposes of this chapter, the following terms, phrases, words and their derivations shall have meanings given herein. When not inconsistent with the context, words used in the present tense include the future; words in the plural include the singular; words in the singular include the plural. The word "shall" is always mandatory and not merely directory.
(a) "Village" or "franchisor" means the Village of Johnstown, Ohio.
(b) "Cable television system" or "system" means a system of coaxial cables or other electrical conductors and transmission equipment used or to be used primarily to receive television or radio signals directly or indirectly off-the-air and other related services and transmit them to subscribers for a fee.
(c) "Company" or "franchisee" means Multi-Channel T.V. Cable Company of Mansfield, Ohio or anyone who succeeds it in accordance with the provisions of this chapter.
(d) "Person" means any person, firm, partnership, association, corporation, company or organization of any kind.
(e) "Channel" means a band of frequencies six megahertz wide in the electromagnetic spectrum which is capable of carrying one audio-video television signal and a number of nonvideo signals.
(f) "Subscriber" means any person, firm, corporation or other entity receiving for any purpose the service of the franchisee.
(g) "Additional channels" means the channels on the system which are reserved by the allocation or reallocation of channels which the franchisee may use for such purposes as automated programming, additional service or over-the-air television broadcasts or by the FCC to be carried on the franchisee system, or other video and/or audio programming except as it may be authorized in the future.
(h) "Council" means the Council of the Village of Johnstown.
(i) "Street" means the surface, the air space above the surface and the area below the surface of any public street, other public right of way or public place.
(j) "Basic service" means the simultaneous delivery by the franchisee to all subscribers' television receivers (or any other suitable type of audio-video communication receivers), a certain number of channels of communication service, including but not limited to, all television broadcast signals defined by the FCC as a "must carry", one channel of governmental information service or public access, three imported television broadcast signals and a mix of character generated signals, additional import signals or local origination programming.
(k) "Premium service" (pay service) means a service provided to subscribers' television receivers (or any other suitable type of audio-video communication receivers) for which the subscriber is charged on a per program or per channel basis.
