A. Jurisdiction: This title shall apply to all land in the county not exempted herein or not within an incorporated municipality. In the event of overlapping jurisdiction within one and one-half (11/2) miles of the municipality exercising subdivision control, the extent of jurisdiction herein shall be as determined and agreed upon between the county and the municipality or municipalities concerned, and approval shall be given if the highest requirements of this title and any other competing ordinance are met. A copy of the proposed plat shall be submitted to said municipality by the subdivider or developer at the time when the preliminary plat is submitted to the plat officer. (Amended Ord., 9-1991; amd. B. Preannexation Agreement: The county board of the county of Jo Daviess hereby finds it to be in the best interest of the citizens of the county of Jo Daviess to retain control and jurisdiction over properties that are more than 1.5 miles from the boundaries of the annexing municipality and subject to annexation agreements. Such property shall remain under the control and jurisdiction of the county board and subject to all county ordinances and codes. (Ord. 2010-5, 9-14-2010)
