9-1-1: RULES AND DEFINITIONS:
The present tense includes the future tense, and vice versa; the masculine gender includes feminine and neuter; the singular includes the plural and vice versa; the word "shall" is always mandatory, the word "may" is always permissive. Unless otherwise expressly stated, the following words shall, for this title, have the meanings herein indicated. Any pertinent word or term not a part of this listing and vital to the interpretation of this title shall be construed to have its usual legal definition.
AREA SERVICE HIGHWAY (State): Highways connecting population centers in the county and adjoining counties.
BLOCK: Property abutting on one side of a street and lying between the two (2) nearest intersecting or intercepting street and railroad right of way, waterway or subdivided area, or other definite boundary.
BUILDING: A structure having a roof supported by columns, walls, arches, or other devices and used for housing, shelter, or enclosure of persons, animals, or other chattels.
COMMISSION: The Jo Daviess County planning commission. Wherever the word "commission" is used, it shall mean the Jo Daviess County planning commission.
CONSTRUCTION: The excavation of earth to provide for a basement or cellar; and/or the addition to or removal from a lot or tract of land of earth, water or trees so as to prepare said lot or tract of land for the creation of a structure; and/or the placing of building materials in a permanent manner; and/or the demolition, elimination or removal of an existing structure.
COUNTY BOARD: The Jo Daviess County board.
COUNTY PLAN: The land use plan of Jo Daviess County or any of its parts as adopted by the county board on February 14, 1989, as amended.
CUL-DE-SAC: A minor residential street with a circular turnaround.
DWELLING: A building designed for residential purposes and containing one or more dwelling units and/or lodging units.
EASEMENT: A grant or right to ingress/egress and use of private land by the owner for designated public, corporation or personal use for specified purposes.
FREEWAY: A highway for through traffic with full or partial control or access.
FRONTAGE ROAD: A secondary thoroughfare or residential street which is parallel to and adjacent to a freeway, major highway or area service highway, and which provides access to abutting properties and protection from through traffic.
GRADE: The ascending or descending inclination with the horizontal of a street, measured along the centerline of the right of way, expressed by stating the vertical rise or fall as a percentage of the horizontal distance.
HALF STREET: A street dedicated to less than its full planned width.
LOT: The tract of land within a subdivision marked by the subdivider on the plat as a numbered, lettered or other identified tract of land to be offered for sale, dedication or development.
LOT, CORNER: A lot located:
   A.   At the junction of and abutting two (2) or more intersecting streets; or
   B.   At the junction of an abutting a street and the nearest short line or high water line of a storm or flood water runoff channel or basin; or
   C.   At the junction of and abutting two (2) or more storm or flood water runoff channels or basins; or
   D.   At the abutting point or abrupt change of a single street where the interior angle is less than one hundred thirty five degrees (135°), and the radius of the street centerline is less than one hundred feet (100').
LOT, INTERIOR: A lot other than a corner lot.
LOT LINES: The lines bounding a lot.
MAJOR HIGHWAY (State): A trafficway connecting communities or connecting to limited access trafficways which, in turn, connect to other communities and which are used primarily for fast and/or large quantities of traffic.
PERFORMANCE BOND OR GUARANTEE: A bond, either in cash or issued by a surety company, conditioned upon the faithful performance of the contract and payment of all obligations arising thereunder.
PLAT:
   A.   A map representing a tract of land, showing the boundaries and location of individual properties and streets.
   B.   A map of a subdivision or site plan.
PLAT, FINAL: A plat submitted for final approval and conforming to the requirements of this title.
PLAT OFFICER: The officer appointed by the chairperson of the county board, with the consent of the county board, whose vested duty is to administer and enforce all of the regulations of this title.
PLAT, PRELIMINARY: A plat from which reproductions can be made and which conforms to the requirements of this title, and is subject to revision prior to county board final approval.
PRIMARY THOROUGHFARE: A street or road designated as such in the transportation plan of the county plan.
PRIVATE ROAD: Any vehicular way which is not dedicated to the public.
RESERVED STRIP: A narrow strip of land, usually along the boundary of a subdivision, that is withheld from sale or dedication by the subdivider to control the development of adjacent land.
RESIDENTIAL STREET: A trafficway which serves primarily for access to abutting properties.
REVERSE FRONTAGE: A lot that is bounded in front and in back by a street.
ROADWAY: Right of way dedicated to and accepted for the public use. "Roadway" means a way for vehicular traffic, whether designated as a street, highway, thoroughfare, expressway, parkway, throughway, road, avenue, boulevard, lane, place or however otherwise designated. The plat officer shall determine in which classification a roadway in a proposed subdivision shall fall.
SECONDARY THOROUGHFARE: A street or road designated as such in the transportation plan of the county plan.
SUBDIVIDER: The person or persons, firm or corporation who are owners of or agents for the area being subdivided and who are responsible for preparing and recording the plat of the subdivision and for carrying out all appropriate requirements outlined in this title for the subdivision of land.
SUBDIVISION: Either:
   A.   The division of land into two (2) or more lots, sites or parcels;
   B.   The resubdivision of land heretofore divided or platted into lots, sites or parcels; or
   C.   Any multiple dwelling units on a single parcel.
SUPERINTENDENT: The superintendent of highways of Jo Daviess County.
SURVEY: The process of ascertaining the area, dimensions and location of a piece of land, prepared by an Illinois registered surveyor, and meeting all the requirements of Illinois state law. (Amended Ord., 9-1991)
