A. Definitions: All the terms and phrases used herein shall have the same meanings as ascribed to them in the cannabis control act, 720 Illinois Compiled Statutes 550/1 et seq., and amendments thereto; except, should the term "person" be limited therein to natural persons who have attained the age of seventeen (17) years or more, said limitation is specifically excluded herein, and the term "person" is made applicable to all natural persons who have attained the age of thirteen (13) years or more.
B. Offense: A person commits the offense of possession of cannabis by knowingly possessing ten grams (10 g) or less of any substance containing cannabis unless permitted or authorized to do so pursuant to the cannabis control act. (Ord., 10-11-2005)
C. Penalty: Any person violating this section shall be subject to a fine as provided in section 1-4-1 of this code. Nothing in this section shall prevent the state's attorney of the county from prosecuting these matters under the criminal laws of the state. (Ord., 10-11-2005; amd. 2009 Code)
