5-12-1: POSSESSION OR USE OF DRUG PARAPHERNALIA AND CONTROLLED SUBSTANCES:
   A.   Offense: It is an offense for any person to use, or to possess with intent to use, drug paraphernalia or to plant, propagate, cultivate, grow, harvest, manufacture, compound, convert, produce, prepare, test, analyze, pack, repack, store, contain, conceal, inject, ingest, inhale, or otherwise introduce into the human body a controlled substance in violation of 720 Illinois Compiled Statutes 550/1 et seq., and 720 Illinois Compiled Statutes 570/100 et seq.    B.   Penalty: Any person violating any provision of this section shall be subject to a fine as provided in section 1-4-1 of this code. Nothing in this section shall prevent the state's attorney of the county from prosecuting these matters under the criminal laws of the state. (Ord., 10-11-2005; amd. 2009 Code)
