5-8-9: COMPLIANCE AND PERFORMANCE:
   A.   Compliance Required:
      1.   No building permit for new structures with indoor plumbing facilities shall be issued nor any mobile home placement approved until a private sewage disposal system installation permit or other written approval shall be obtained from the health department.
      2.   All private sewage disposal systems within the limits of the county shall be constructed, installed, approved, modified or maintained by an individual with a valid private sewage disposal system installation contractor's license; and all such systems shall be pumped, cleaned, and the contents disposed of by individuals with a valid private sewage disposal system pumping contractor's license; provided, however, that a homeowner may install and/or service a private sewage disposal system which serves his own personal single-family residence.
      3.   All septic tanks and/or aerobic units manufactured, sold, offered for sale, or delivered in the county shall comply with provisions of this chapter.
   B.   Performance Requirements:
      1.   An approved effluent filter shall be installed between any conventional septic tank and the septic field/sand filter. It shall be required as part of the plan for a septic permit. Such filter may also function as the outlet baffle. A riser must be in place for proper inspection and maintenance of the effluent filter. An approved riser would be a concrete riser or a plastic riser pipe which is large enough in diameter to effectively gain access to the effluent filter. Riser must be either concrete or plastic that is completely secured. A riser pipe must be constructed of a material that is approved by the health department, joined by means of a screw thread to the opening of the pipe, and of a diameter that allows for maintenance of the effluent filter.       2.   Sand filters must have sidewalls and bottoms that are lined with an impervious liner. The liner bottom shall be protected from protruding rocks. Soils under a sand filter, and sidewalls, shall not have any rocks protruding more than one inch (1"). The liner top shall be protected from the first layer of placed aggregate. Liner placement, seaming and patching shall meet manufacturers' recommendations. A lined, buried sand filter may be installed with a one-fourth (1/4) reduction to the subsurface drainfield size.       3.   On raised drainfields, where fill material is used for covering the drainfield, fill soils must be approved for use by the department, and inspections of site preparation and fill soils placement may be required prior to installation of trenches.
      4.   Curtain drain construction, when required, shall be installed according to accepted engineering practices and any specifications on the soil boring report. Department personnel, prior to the covering of the work, must inspect curtain drain installations.
      5.   Dosing siphons or wastewater pumps shall be used to feed sand filters serving wastewater design flows of over one thousand (1,000) gallons per day.
      6.   On systems that require pumps, all force mains are to go around the subsurface drainfield area. Only in circumstances where the lot has size barriers shall the force main go over the drainfield. If there are size limitations on a lot, the health department is to be contacted prior to installation, and approval must be granted before construction begins.
      7.   Where sewer lines must cross over water lines, all provisions set forth in the private sewage disposal licensing act and code must be followed. A minimum of a ten foot (10') section of schedule 40 or a thicker walled plastic pipe must be placed over the sewer line. The sewer line sleeve must be at least six inches (6") in diameter.
      8.   In new construction situations where any part of a sewer or effluent line goes under a driveway or any area that has vehicle traffic, a section of schedule 40 or thicker walled plastic pipe must be placed over the entire length of the sewer/effluent line that will be under the driveway or parking area, etc. The line sleeve must be at least six inches (6") in diameter.
      9.   Surface discharge shall be prohibited. There shall be no discharge of raw or improperly treated domestic sewage to the surface of the ground or to farm tiles, streams, rivers, ponds, lakes, or other collectors of water. "Improperly treated domestic sewage" is sewage that does not meet the effluent requirements as stated in the current, unabridged form of the state department of public health "private sewage disposal licensing act and code" or sewage which comes directly from a septic tank or building sewer. Domestic sewage or effluent from any private sewage disposal system or component shall not be discharged into any well, cistern or basement or into any underground mine, cave, sinkhole or tunnel.
   C.   Evaluations And Inspections:
      1.   At the request of a homeowner or the homeowner's representative, the health department shall conduct a visual sanitary evaluation of a property in order to determine general compliance with this chapter. The health department shall charge a fee for this service. The fee shall be in accordance with the county's fee schedule.
      2.   The health authority shall have the authority to enter any property at any reasonable time for inspection purposes to determine compliance with the provisions of this chapter. It shall be the duty of the owner or occupant of a property to allow the health authority free access to the property for inspection purposes to determine compliance with the provisions of this chapter.
