The following definitions shall apply in the interpretation and enforcement of this chapter:
AUTHORIZED REPRESENTATIVE: The legally designated administrator or the acting administrator of the Jo Daviess County health department and shall include those persons designated by the administrator or acting administrator to enforce the provisions of this chapter.
BOARD OF HEALTH: The Jo Daviess County board of health or its authorized representative(s).
DOMESTIC SEWAGE: Wastewater derived principally from plumbing fixture drains in dwellings, business or office buildings, institutions, food service establishments, and similar facilities. The term shall not include industrial or commercial processing waste.
HEALTH AUTHORITY: The person or persons who have been designated by the board of health to administer the affairs of the health department.
HEALTH DEPARTMENT: The Jo Daviess County public health department, an agency of the Jo Daviess County board of health.
HOMEOWNER: A contract for deed buyer or a person who holds legal title to a residential structure which is to be used or is used for his personal single-family residence.
HOMEOWNER INSTALLED SYSTEM: A private sewage disposal system installed by a homeowner for his personal single-family residence.
MODIFY: Any change in the design or components of a private sewage disposal system requiring a "permit", as defined in this section.
PERMIT: A written permit issued by the board of health or its authorized representative permitting the construction of an individual sewage disposal system under this chapter.
PRIVATE SEWAGE DISPOSAL SYSTEM: Any sewage handling or treatment facility receiving domestic sewage from less than fifteen (15) people or population equivalent, or any sewage handling or treatment facility receiving domestic sewage and having no ground surface discharge.
PRIVATE SEWAGE DISPOSAL SYSTEM CONTRACTOR'S LICENSE: An annual license issued by the Jo Daviess County public health department to all private sewage disposal contractors engaged in the installation and/or servicing of private sewage disposal systems within the limits of Jo Daviess County.
PRIVATE SEWAGE DISPOSAL SYSTEM INSTALLATION CONTRACTOR: Any person excavating, constructing, repairing, installing, modifying, or maintaining a private sewage disposal system.
PRIVATE SEWAGE DISPOSAL SYSTEM PUMPING CONTRACTOR: Any person who cleans or pumps waste from a private sewage disposal system or hauls or disposes of waste removed therefrom. The term includes any person who provides any portable toilet services.
REPAIR: The reconstruction of one component of the private sewage disposal system (e.g., septic tank or subsurface drainfield).
SEPTIC TANK MANUFACTURER'S AND/OR AERATION UNIT DEALERS: Any person who manufactures, sells, offers for sale, or delivers septic tanks or aeration units in or into Jo Daviess County.
VARIANCE: A circumstance that exists that makes compliance with the requirements of this chapter impossible. (Ord., 4-7-2008)
