An opportunity for a hearing on hold orders, suspension, or revocation of a license will be provided if a written request is filed with the regulatory authority within ten (10) business days of notice. If a written request is received, the hearing shall be held within twenty (20) business days after receipt of the request. If no written request is received within the set time, the following will occur:
Hold order: The food shall be destroyed or denatured.
Suspension: License becomes revoked.
Revocation: Becomes final.
The hearings provided for in this chapter shall be conducted by the regulatory authority at a designated time and place. Any oral testimony given at a hearing shall be reported verbatim, and the Public Health Administrator shall make the final finding based upon the complete hearing record and shall sustain, modify or rescind any notice or order considered in the hearing. A written report of the hearing decision shall be furnished to the license holder by the regulatory authority. (Ord. 2018-10, 10-9-2018, eff. 12-1-2018)
