If the regulatory authority finds that the structural facilities and/or equipment of any food establishment for which a license is sought are not in substantial compliance with this chapter but that such food establishment may operate without undue prejudice to public health, a conditional license may be issued setting forth the conditions on which the license is issued, and shall set forth the time, not to exceed three (3) years, within which the applicant must make any changes or corrections necessary in order for such food establishment to comply fully with this chapter.
