AN ORDINANCE AMENDING TITLE 1 ADMINISTRATION, CHAPTER 7 CITY OFFICERS AND PERSONNEL; GENERAL PROVISIONS, BY ADOPTING A NEW SECTION 1-7-9, RESOLUTION "A" AND COLLECTIVE BARGAINING AGREEMENTS ADOPTED BY REFERENCE, AND EXEMPTING THE CITY FROM THE PAID LEAVE FOR ALL WORKERS ACT
 
WHEREAS the City of Jerseyville ("City") is a municipal corporation lawfully organized and existing under the Constitution and laws of the State of Illinois, including, without limitation, the Illinois Municipal Code (65 ILCS 5/1, et seq.) ("Code");
WHEREAS the City is empowered by the Code to pass new ordinances for the protection, health, safety, and general welfare of its citizens and employees;
WHEREAS the City Council from time-to-time for the general welfare and safety of the community and the City employees, establishes policies, procedures, rules, and regulations regarding personnel practices to facilitate the employment of qualified personnel, maintain high standards of employee conduct, and to provide for compensation and benefits, including paid leave for vacation days, sick days, personal days, and bereavement days, for its employees;
 
WHEREAS the City Council also reviews current City personnel practices, procedures, ordinances, rules, and regulations to ensure compliance with state and federal laws and regulations, including the recently passed Illinois Paid Leave for All Workers Act (PLAWA);
WHEREAS effective January 1, 2024, Section 15 (p) of the PLAWA requires an employer to provide certain paid leave to their employees, unless the employer is subject to an existing municipal or county ordinance that requires the employer to provide any form of paid leave to their employees;
 
WHEREAS the City recognizes the importance of paid leave and currently provides reasonable paid leave benefits to its employees and has determined that applying the PLAWA to its own employees is unnecessary and will negatively impact the City and place an undue financial and operational burden on the City's ability to provide uninterrupted services to its residents;
 
WHEREAS the City believes and hereby declares that it is in the best interests of the City to continue to clearly define the paid leave benefits that City employees have been receiving and shall continue to receive; and
 
WHEREAS the City has provided for non-union employee compensation, personnel policies, and procedures, with the inclusion of paid leave for vacation days, sick days, personal days, and bereavement days, by Resolution A adopted from time to time by the City Council, the most recent version of which is on file with the City Clerk; and for union employee compensation, personnel policies, and procedures, with the
 
inclusion of paid leave for vacation days, sick days, personal days, and bereavement days in the current collective bargaining agreements to which the City is a party, the most recent versions of which are on file with the City Clerk; and said Resolution A and collective bargaining agreements satisfy the exemption requirements of Section 15(p) of the PLAWA;
 
NOW THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF JERSEYVILLE, ILLINOIS, AS FOLLOWS:
SECTION 1. The above recitals in the WHEREAS clauses are true and correct findings of fact and are integral to the understanding and terms of this ordinance and are fully incorporated into this Ordinance and adopted by this reference thereto.
SECTION 2. A new Section 1-7-9, RESOLUTION "A" AND COLLECTIVE
BARGAINING AGREEMENTS ADOPTED BY REFERENCE is adopted as follows:
 
"1-7-9      RESOLUTION "A" AND COLLECTIVE BARGAINING AGREEMENTS ADOPTED BY REFERENCE.
 
The city's currently enforce Resolution ' " and Collective Bargaining Agreements, and as amended from time to time in the future, are hereby adopted by reference, and incorporated herein as if set out in full. Copies of the each have been on file since adopted and will continue to be on file and available for viewing in the City Clerk's Office at City Hall."
 
SECTION 3. Pursuant to Section 15(p) of the Act, the City hereby adopts its current paid leave policy for all non-union City employees as set forth in the City Code of Ordinances, Resolution "A", and for all union employees as provided in applicable collective bargaining agreements to which the City is a party, and all other binding legislative actions governing paid leave adopted by the City Council and Mayor, as the same may be amended from time to time. However, in no event shall the City, as an employer, provide less than one (1) day of paid leave per year to any City employee.
 
SECTION 4'. This Ordinance is in full force and effect upon its passage, approval and publication in pamphlet form as provided by law.
